Agencia Peruana de Noticias PRENSAPERU.PE https://prensaperu.pe/ Twitter: @prensaperupe Como parte del esfuerzo del Gobierno por promover el desarrollo científico y tecnológico del país, el Ejecutivo, a través de la Presidencia del Consejo de Ministros (PCM), emitió el decreto supremo que aprueba el Reglamento de la Ley del Sistema Nacional de Ciencia, Tecnología e Innovación (Ley nro. 31250).

Este dispositivo legal representa un avance en el fortalecimiento de la gobernanza a nivel nacional que promoverá la articulación entre los tres niveles de Gobierno, las entidades privadas, la academia y la sociedad civil, a fin de alcanzar los objetivos nacionales en el desarrollo científico y tecnológico.

Además, establece las pautas para los procedimientos administrativos sancionadores que permitan determinar las infracciones en las actividades de ciencia, tecnología e innovación; y las sanciones aplicables a las personas naturales que pertenezcan a las entidades del Sistema Nacional de Ciencia, Tecnología e Innovación (Sinacti) y a los investigadores que hayan recibido financiamiento del Concytec o Prociencia, entre otros actores.

Asimismo, dispone sancionar con una multa de hasta 320 Unidades Impositivas Tributarias (UIT), que equivalen a S/ 1 648 000, a quienes cometan la infracción de compra o venta de autoría de una o más investigaciones científicas.

Esta práctica, que es considerada una infracción muy grave a la ética en investigación, también conlleva la expulsión definitiva del Sinacti, lo cual genera que la persona natural o jurídica quede prohibida de recibir, de manera definitiva, los servicios Concytec, como la clasificación, el registro de investigadores, entre otros.

También se sanciona de manera similar a los que empleen indebidamente los recursos otorgados en subvenciones o transferencias financieras para los fines dispuestos en las bases, convenios, contratos u otros instrumentos.

El reglamento, aprobado mediante decreto supremo nro. 062-2024-PCM, también dispone que el Concytec es la entidad responsable de regular la implementación y el funcionamiento del registro de sanciones, como parte del procedimiento administrativo sancionador.

Este registro deberá ser implementado, a través de resolución de presidencia, en un plazo no mayor a los sesenta días calendario, los cuales se cuentan desde la vigencia del reglamento.

Executive approves regulations that detail fines of up to 320 UIT for those who buy or sell authorship in scientific research.

This legal device represents progress in strengthening governance at the national level that will promote coordination between the three levels of Government, private entities, academia and civil society, in order to achieve national objectives in scientific and technological development. .

In addition, it establishes the guidelines for administrative sanctioning procedures that allow the determination of infractions in science, technology and innovation activities; and the sanctions applicable to natural persons who belong to the entities of the National System of Science, Technology and Innovation (Sinacti) and to researchers who have received funding from Concytec or Prociencia, among other actors.

Likewise, it provides for sanctioning with a fine of up to 320 Tax Tax Units (UIT), which is equivalent to S/ 1,648,000, for those who commit the violation of buying or selling the authorship of one or more scientific research.

This practice, which is considered a very serious violation of research ethics, also entails definitive expulsion from Sinacti, which means that the natural or legal person is permanently prohibited from receiving Concytec services, such as classification, the registry of researchers, among others.

Those who improperly use the resources granted in subsidies or financial transfers for the purposes established in the bases, agreements, contracts or other instruments are also sanctioned in a similar manner.

The regulations, approved by supreme decree no. 062-2024-PCM, also provides that Concytec is the entity responsible for regulating the implementation and operation of the sanctions registry, as part of the administrative sanctioning procedure.

This registry must be implemented, through a presidential resolution, within a period of no more than sixty calendar days, which are counted from the effective date of the regulation.
