La jueza Sonia Tello del juzgado civil de Canta anuló el acto de notificación de medidas de protección por errores formales, pero precisó que la orden de terapia sigue vigente y no puede ser eludida invocando la inmunidad parlamentaria, ya que esta no aplica a procedimientos de naturaleza civil o de tutela de derechos. La apelación fue concedida sin efecto suspensivo, por lo que el plazo de 15 días hábiles para iniciar el tratamiento ya está en curso.

El tratamiento incluye sesiones para el manejo de impulsividad, control de la ira y abordaje de conducta sexual patológica, en el marco de una denuncia por presunta violación sexual presentada el 30 de diciembre de 2024 por una mujer de 31 años, quien relató que los hechos ocurrieron durante una reunión de fin de año en Canta. Aunque la fiscalía archivó la denuncia en agosto de 2025 al determinar que no había méritos suficientes (con base en un informe de ADN que no coincidió con el del político), la orden de terapia se mantuvo como medida preventiva. Además, Jerí enfrenta investigaciones por desobediencia a la autoridad (por incumplimiento inicial del tratamiento) y presunto enriquecimiento ilícito vinculado a su gestión en la Comisión de Presupuesto del Congreso.

La figura de Jerí genera amplios cuestionamientos políticos y sociales: en julio de 2025 firmó el informe que recomendó archivar la denuncia constitucional contra la ex mandataria Dina Boluarte por las más de 50 muertes ocurridas durante las protestas de 2022-2023, medida criticada por organismos internacionales como la CIDH y la ONU, que documentaron ejecuciones extrajudiciales y uso desproporcionado de la fuerza. Asimismo, antiguos tweets del presidente han sido difundidos, revelando expresiones machistas, misóginas y sexualizadoras que reflejan una visión patriarcal incompatible con su cargo.

1.- La inmunidad parlamentaria tiene límites claros definidos por la justicia: El fallo confirma que esta protección solo cubre actos relacionados con el ejercicio de funciones legislativas, no pudiendo ser utilizada para eludir medidas judiciales que buscan resguardar la integridad de terceros o abordar condiciones que puedan representar un riesgo para la sociedad.

2.- Las medidas judiciales se mantienen aunque la denuncia penal sea archivada: La orden de terapia psicológica persiste como acción preventiva, lo que indica que el sistema judicial considera que existen elementos que justifican la necesidad de abordar la patología psicosexual detectada, independientemente de los resultados de la investigación penal.

3.- El acceso al poder no garantiza impunidad, pero sí puede generar desequilibrios en la aplicación de la justicia: El archivo de la denuncia penal contra Jerí, junto con el nombramiento del fiscal encargado apoyado por un pacto congresal, ha generado dudas sobre la autonomía del poder judicial frente a figuras políticas relevantes, mientras que el otro imputado del caso (Marco Cardoza) se encuentra prófugo y su investigación continúa.

4.- El riesgo de personas con alteraciones psíquicas y posturas dañinas en cargos públicos es altísimo: Cuando quienes detentan el máximo poder del país presentan patologías que afectan su control emocional y conductual, además de mantener visiones machistas y discriminatorias, sus decisiones pueden comprometer la justicia, los derechos humanos y la seguridad de la población, como demostró el caso del blindaje a Boluarte y los cuestionamientos en torno a su conducta.

Although the prosecutor’s office closed the case in August 2025 after determining there was insufficient evidence (based on a DNA report that did not match the politician’s), the therapy order was maintained as a preventive measure. Additionally, Jerí is facing investigations for disobedience to authority (for initially failing to comply with the treatment) and alleged illicit enrichment linked to his management in the Congress Budget Committee.

Jerí’s figure generates widespread political and social criticism: in July 2025, he signed the report recommending the closure of the constitutional complaint against former president Dina Boluarte for the more than 50 deaths that occurred during the 2022-2023 protests. This measure was criticized by international organizations such as the Inter-American Commission on Human Rights (IACHR) and the United Nations (UN), which documented extrajudicial executions and disproportionate use of force. Likewise, old tweets from the president have been circulated, revealing misogynistic, sexist, and sexualizing remarks that reflect a patriarchal worldview incompatible with his position.

3.- Access to power does not guarantee impunity, but it can create imbalances in the application of justice: The closure of the criminal complaint against Jerí, along with the appointment of the lead prosecutor supported by a congressional pact, has raised doubts about the autonomy of the judiciary in the face of prominent political figures. Meanwhile, the other defendant in the case (Marco Cardoza) is a fugitive and his investigation continues.

4.- The risk posed by individuals with psychological disorders and harmful stances in public office is extremely high: When those holding the country’s highest power have conditions that affect their emotional and behavioral control, in addition to maintaining misogynistic and discriminatory views, their decisions can compromise justice, human rights, and public safety—as demonstrated by the protection of Boluarte and the questions surrounding his own conduct.
