Plantean modificar reglas electorales para las próximas elecciones ahora será el pleno del Congreso de la República si lo aprueba o no.

Agencia Peruana de Noticias PRENSAPERU.PE https://prensaperu.pe Twitter: @prensaperupe Con la finalidad de fomentar un proceso electoral seguro frente a la emergencia sanitaria de la COVID-19 y el adecuado ejercicio del derecho a sufragio de la ciudadanía, la Comisión de Constitución y Reglamento aprobó, con 14 votos a favor, el texto sustitutorio que plantea modificaciones en las reglas electorales aplicables a las elecciones regionales y municipales del 2022; y ahora será el pleno del Congreso quién decidirá si se aprueba o no y se convierte en norma de imperio cumplimiento en el país.

Entre ellas, la suspensión de las elecciones primarias y la cancelación de la inscripción de los partidos políticos que no participen en esos comicios.

Fue este martes 14 en la sesión conducida por la presidenta de ese grupo de trabajo, la congresista Patricia Juárez Gallegos (FP). El dictamen reúne los proyectos de ley 0113/2021-CR, 0128/2021-CR y 0136/2021-CR.

La sustentación del referido dictamen estuvo a cargo de la presidenta de la comisión quien sostuvo que se ha considerado la incorporación y la modificación de diversas disposiciones transitorias en la normativa electoral, específicamente en la Ley de Organizaciones Políticas, Ley 29084, así como en la Ley Orgánica de Elecciones, Ley 26859.

“La reforma tendrá como objetivo la suspensión de la aplicación de las normas que regulan las elecciones primarias con relación a las elecciones regionales y municipales del 2022, así como la inaplicación temporal de algunos artículos de las citadas leyes, con el objetivo de modificar determinados plazos administrativos a efectos de coadyuvar al pleno ejercicio del derecho de sufragio pasivo”, afirmó la congresista Juárez.

Las medidas responden al actual contexto de emergencia nacional ocasionada por la crisis sanitaria y económica generada por la pandemia de la COVID-19.

“En ese sentido, estas medidas están orientadas a coadyuvar de forma conexa a las políticas públicas dirigidas a la prevención y erradicación de la enfermedad, a fin de no mellar o restar eficacia al proceso de vacunación nacional y otras medidas similares”, agregó la presienta de la Comisión de Constitución y Reglamento.

Además, explicó que lo que se dejaría en suspensión, y no los elimina, son las elecciones primarias que serían una modalidad que recién se ha introducido en modificaciones recientes que hasta la fecha no se ha aplicado y que implicaría que todos los ciudadanos -sin excepción- tienen que salir a elegir a los candidatos de los diferentes partidos políticos a nivel nacional.

“Esto significaría una elección anterior a la propia elección para elegir a los gobernadores regionales y a los alcaldes. Esto es lo que en este momento -como ocurrió en la elección 2021- se dejaría en suspensión”, aclaró.

Por su parte, Luis Aragón Carreño (AP) aclaró que una organización política -de acuerdo a la Ley de Partidos Políticos- tiene elecciones internas y las elecciones primarias que el dictamen señala son elecciones primarias generales abiertas para toda la población.

“Estamos hablando de las condiciones sanitarias que no permiten por ahora el ejercicio de estas elecciones primarias, pero eso no significa y no limita que cada partido político tenga elecciones internas en su propia organización. Cada partido político tiene elecciones internas y las va seguir teniendo, eso es lo mejor que hay, la democracia interna”, agregó.

A su turno, Edgard Reymundo (JPP) subrayó la necesidad de suspender la aplicación de las elecciones primarias. “Estamos de acuerdo y esperamos que sea por única vez, y después adecuarnos paulatinamente”.

Por su parte, Wilson Soto (AP) observó que en el fondo se quiere que los partidos o movimientos regionales que no cumplan los requisitos para participar en elecciones regionales y municipales del 2022 lo puedan hacer; sin embargo -dijo- se debería buscar fortalecer a los partidos políticos para que se cumpla la norma y no beneficiar a los que están en el margen con el pretexto de la pandemia.

“Participar en la vida política en el país es un derecho constitucional, pero bajo reglas prestablecidas y no que se vengan cambiando por intereses que no precisamente buscan mejorar la vida democrática”, agregó.

A su vez, Alejandro Aguinaga (FP) señaló que a su agrupación política le parece razonable la prórroga a estas modificaciones de las leyes. Indicó que no es excepcional ni tampoco una excusa, porque la realidad en que se vive es una pandemia y ello ha trastocado al devenir normal que tenemos como país.

“En la prórroga del plazo, deberíamos acoger una fecha fija para no estar discutiendo ni debatiendo; y proponemos el 31 de diciembre, justo para el cambio de las leyes y el 5 de febrero para el reglamento”, propuso.

Mientras que Alejandro Cavero Alva (Avanza País) propuso que se haga una precisión con respecto a que se instalaría un portal electoral digital. “Creo que eso es importante, porque necesitamos caminar hacia la digitalización de los procesos electorales”, sostuvo.

Por su parte, Eduardo Salhuana (APP) consideró necesario que se aplique las elecciones primarias para las elecciones regionales y municipales del próximo año. “Creemos que se debe fortalecer los partidos políticos”, dijo.

PROYECTO DE LEY
Antes, el congresista Pasión Neomias Dávila Atanacio, del grupo parlamentario Perú Libre, se encargó de sustentar el proyecto de ley 0152/2020-CR, Ley que modifica la Ley 27683, Ley de Elecciones Regionales y la Ley 26894, Ley de Elecciones Municipales, para garantizar el cumplimiento de los mandatos de elección popular de cuatro años en los gobiernos regionales y locales

Se plantea que no pueden ser candidatos en las elecciones de gobiernos regionales los siguientes ciudadanos: el presidente, los vicepresidentes de la República, los congresistas de la República (salvo que culminen su mandato por el cual han sido elegidos) ni los alcaldes que deseen postular al cargo de presidente regional.

Señala también que pueden ser candidatos, siempre y cuando renuncien de manera irrevocable 180 días antes de la fecha de las elecciones, los siguientes funcionarios: los ministros y viceministros de Estado, los magistrados del Poder Judicial, del Ministerio Público y del Tribunal Constitucional, el contralor general de la República y los miembros del Consejo Nacional de la Magistratura.

Lo mismo ocurre con los siguientes funcionarios: los miembros del Jurado Nacional de Elecciones, de la Oficina Nacional de Procesos Electorales, y el jefe de Registro Nacional de Identificación y Estado Civil, el defensor del Pueblo, el presidente del Banco Central de Reserva del Perú, el superintendente de Banca Seguros y Administradoras de Fondo de Pensiones, el superintendente de Administración Tributaria, los titulares y miembros directivos de los organismos públicos y directores de las empresas del Estado.

While Alejandro Cavero Alva (Avanza País) proposed that a clarification be made regarding the installation of a digital electoral portal. “I think that is important, because we need to move towards the digitization of electoral processes,” he said.

For his part, Eduardo Salhuana (APP) considered it necessary to apply the primary elections for the regional and municipal elections next year. “We believe that political parties should be strengthened,” he said.
