Cuatro importantes dossier legislativos fueron aprobado por el Congreso que beneficiarán a millones de peruanos.

La propuesta sustentada por el congresista Ernesto Bustamante Donayre (FP), presidente de la Comisión de Relaciones Exteriores, tiene por objeto la constitución de una unión particular conformado por los Estados a los que se aplica el mismo, los cuales, a su vez, adoptan una misma clasificación para los dibujos y modelos industriales, la clasificación de Locarno.

Expresó que la clasificación de Locarno comprende una lista de clases y subclases, una lista alfabética de productos que pueden ser objeto de dibujos y notas explicativas. En virtud del artículo 3 del Arreglo de Locarno, el Comité de Expertos puede introducir modificaciones y complementos en la lista de las clases y de las subclases; asimismo, adoptará la lista alfabética de los productos y notas explicativas (artículo 1 .3, 1.4 y 1.5).

Al respecto, no hubo intervenciones y la resolución se aprobó por unanimidad con 109 votos.

ARREGLO DE ESTRASBURGO
La Representación Nacional también aprobó por unanimidad (107 votos) la Resolución Legislativa sobre el Arreglo de Estrasburgo relativo a la clasificación Internacional de Patentes, adoptado en Estrasburgo el 24 de marzo de 1971.

El congresista Ernesto Bustamante, presidente de la comisión de Relaciones Exteriores, señaló que la misma tiene por objeto la constitución de una unión particular conformada por los Estados a los que se aplica el mismo, los cuales, adoptan una clasificación común para las patentes de invención, los certificados de inventor, los modelos de utilidad y los certificados de utilidad, la Clasificación de Estrasburgo.

Bustamante señaló que es importante y beneficiosa nuestra adhesión al Arreglo de Estrasburgo y al Arreglo de Locarno con el fin de contar con una participación más activa en las reuniones y decisiones de la Asamblea y del Comité de Expertos, así como conocer las recomendaciones y trabajo de los distintos grupos especializados, a fin de poder mejorar la gestión de las solicitudes de patentes y diseños industriales presentadas ante la Dirección de Invenciones y Nuevas tecnologías del Indecopi.

“Esto va a permitir optimizar los servicios que se brinda a los usuarios del sistema de patentes y diseños industriales en el Perú”, dijo.

ACUERDO DE VIENA
De igual forma, el Pleno aprobó con 112 votos a favor el Acuerdo de Viena por el que se establece una Clasificación Internacional de los Elementos Figurativos de las Marcas, adoptado en Viena el 12 de junio de 1973.

La propuesta indica que el Acuerdo de Viena busca la constitución de una unión especial conformada por los Estados a los que se aplica los mismos, los cuales, a su vez, adoptan una clasificación común para los elementos figurativos de las marcas, la Clasificación de Viena.

ACUERDO ENTRE PERÚ Y BOLIVIA
Asimismo, la Representación Nacional aprobó por unanimidad (115 votos) la Resolución Legislativa que propone aprobar el Acuerdo entre la República del Perú y el Estado Plurinacional de Bolivia sobre el Derecho de Paso para la Navegación en el Lago Titicaca, suscrito el 25 de junio de 2019, en la ciudad de Ilo, República del Perú.

La norma tiene por objeto regular el derecho de paso de las embarcaciones de un Estado, parte en el Lago Titicaca, con el fin de atravesar aguas del otro Estado, en un viaje con origen y destino el territorio de un mismo Estado.

Señala que este Acuerdo regula derechos y obligaciones jurídicamente vinculantes entre el Perú y Bolivia.

En razón a ello, regula el derecho de paso para atravesar las aguas del otro Estado, sobre el cual se establecen precisiones y condiciones, además de establecer disposiciones generales, como la obligación de no realizar actos o actividades ilícitas, y normas específicas, como la forma de elaboración de disposiciones sobre seguridad en la navegación y el tráfico acuático.

“El acuerdo facilitará la navegación de naves entre pueblos y puntos de embarque del mismo país, en igualdad de condiciones y trato equitativo, sin afectar la soberanía ni la jurisdicción de ambos Estados, con impacto positivo en el traslado de personas y el comercio entre comunidades ribereñas de Perú y Bolivia, así como el turismo”, puntualizó Bustamante.
