Poder Judicial presenta este 20 de abril la guía para actores judiciales y acceso a la justicia de personas refugiadas y migrantes en el Perú.

Acceso a la justicia de personas refugiadas y migrantes en el Perú”.

Esta publicación constituye una importante herramienta de estudio para los diferentes actores que participan en el sistema de justicia (juezas, jueces, fiscales, defensores públicos, policías, etc.), cuya lectura y aplicación resulta de carácter obligatorio.

El objetivo de este documento es conocer la situación y garantizar el efectivo acceso a la justicia de las personas en movilidad humana, como refugiadas, migrantes y apátridas, sin importar su nacionalidad o situación migratoria, desde un enfoque de derechos humanos.

Cabe señalar que la guía es el resultado del trabajo entre la referida comisión, el Instituto de Democracia y Derechos Humanos de la Pontificia Universidad Católica del Perú (IDEHPUCP) y la Agencia de las Naciones Unidas para los Refugiados (ACNUR).

Al respecto, Tello Gilardi sostuvo que esta labor conjunta contribuye a superar las barreras y dificultades que enfrentan día a día las personas refugiadas y migrantes, situación que les impide ejercer sus derechos y libertades plenamente, en condiciones de igualdad.

ESTRUCTURA DE LA GUÍA
El documento desarrolla principios, estándares internacionales y criterios jurisprudenciales de protección, así como decisiones a considerar en los procedimientos de control migratorio y en la determinación de la condición de refugiado.

Así, la guía está estructurada en seis partes: en la primera trata conceptos claves y definiciones de los principales instrumentos jurídicos internacionales de protección a personas refugiadas y migrantes, de manera especial el Sistema Interamericano de Derechos Humanos (SIDH)

Luego, en la segunda, el texto establece el sentido del acceso a la justicia, donde presenta el rol de los actores judiciales en la garantía y protección de los derechos de las personas en contextos de movilidad humana.

La tercera parte del documento está enfocada en las personas refugiadas y solicitantes de refugio, identificando el contenido y los alcances del derecho a buscar y recibir asilo, así como del principio de no devolución.

En la cuarta, la guía aborda las garantías de acceso a la justicia en los procesos de control migratorio, con énfasis en casos de detenciones y expulsiones, en tanto que en la quinta desarrolla premisas respecto a niñas, niños y adolescentes, así como personas LGTBIQ+ en situación de movilidad.

El material bibliográfico concluye con consideraciones referentes al acceso a la justicia de personas refugiadas y migrantes, poniendo énfasis en el principio de no discriminación y en los derechos económicos, sociales y culturales.

SOBRE LA PRESENTACIÓN
En la ceremonia –que se realizará en Palacio de Justicia– participarán la jueza Janet Tello Gilardi, así como Félix Reátegui, de IDEHPUCP, y Federico Luis Agusti, de ACNUR en Perú, quienes darán las palabras de bienvenida.

La presentación de la guía estará a cargo de sus autores, Agustín Grandez y Gabriela Ramos, de IDEHPUCP, mientras que los jueces Ramiro Bustamante y Carlos Calderón Puertas, comentarán el material.

This publication constitutes an important study tool for the different actors that participate in the justice system (judges, judges, prosecutors, public defenders, police officers, etc.), whose reading and application is mandatory.

The objective of this document is to understand the situation and guarantee effective access to justice for people in human mobility, such as refugees, migrants and stateless persons, regardless of their nationality or migratory status, from a human rights approach.

It should be noted that the guide is the result of work between the aforementioned commission, the Institute of Democracy and Human Rights of the Pontifical Catholic University of Peru (IDEHPUCP) and the United Nations Refugee Agency (UNHCR).

In this regard, Tello Gilardi said that this joint work contributes to overcoming the barriers and difficulties that refugees and migrants face every day, a situation that prevents them from fully exercising their rights and freedoms, in equal conditions.

STRUCTURE OF THE GUIDE
The document develops principles, international standards and jurisprudential criteria for protection, as well as decisions to consider in immigration control procedures and in the determination of refugee status.

Thus, the guide is structured in six parts: the first deals with key concepts and definitions of the main international legal instruments for the protection of refugees and migrants, especially the Inter-American Human Rights System (IACHR).

Then, in the second, the text establishes the meaning of access to justice, where it presents the role of judicial actors in guaranteeing and protecting the rights of people in contexts of human mobility.

The third part of the document is focused on refugees and asylum seekers, identifying the content and scope of the right to seek and receive asylum, as well as the principle of non-refoulement.

In the fourth, the guide addresses the guarantees of access to justice in immigration control processes, with emphasis on cases of detention and expulsion, while in the fifth it develops premises regarding children and adolescents, as well as LGTBIQ+ people. in a situation of mobility.

The bibliographical material concludes with considerations regarding access to justice for refugees and migrants, emphasizing the principle of non-discrimination and economic, social and cultural rights.

ABOUT THE PRESENTATION
Judge Janet Tello Gilardi, as well as Félix Reátegui, from IDEHPUCP, and Federico Luis Agusti, from ACNUR in Peru, will participate in the ceremony -which will take place in the Palace of Justice-, who will give welcoming remarks.
