De acuerdo a lo que establece el Decreto Supremo N° 081-2022-PCM publicado hoy en las normas legales del Diario Oficial El Peruano, la referida comisión tendrá el encargo de elaborar un informe técnico de dicha propuesta considerando la no afectación a la sostenibilidad fiscal, además de otro informe que contenga una evaluación real del sistema previsional peruano.

El grupo de trabajo estará conformado por el presidente del Consejo de Ministros; el viceministro de Economía del Ministerio de Economía y Finanzas (MEF); el viceministro de Hacienda del MEF; el viceministro de Trabajo del Ministerio de Trabajo y Promoción del Empleo y un representante de la Presidencia del Consejo de Ministros (PCM).

Además, un representante del Banco Central de Reserva del Perú (BCR) y un representante de la Superintendencia de Banca, Seguros y AFP (SBS). Los integrantes de la Comisión Multisectorial contarán con un representante alterno (a) y el ejercicio de sus funciones de los titulares y alternos (as) no representarán gasto al Estado, porque será ad honorem.

Según la normativa promulgada, dicha comisión está autorizada de solicitar información, colaboración, asesoramiento, apoyo, opinión o aportes técnicos de voceros de la sociedad civil, y representantes de entidades públicas o privadas del ámbito nacional e internacional.

La Comisión Multisectorial tiene un período de vigencia de seis meses, contado a partir de su instalación.

SUSTENTO DEL DECRETO SUPREMO
En los últimos años se han conformado diversas comisiones con miras a una reforma del Sistema Previsional Peruano, tanto en el Poder Ejecutivo y en el Poder Legislativo; sin embargo, hasta el momento, no se ha concretado una propuesta normativa consensuada con todos los involucrados.

En tal sentido, resulta necesario crear una Comisión Multisectorial, de naturaleza temporal, para elaborar los Informes Técnicos que contengan una evaluación del sistema previsional peruano, la misma que tiene opinión favorable de la Secretaría de Gestión Pública de la Presidencia del Consejo de Ministros.

Cabe precisar que en los artículos 10 y 11 de la Constitución Política del Perú, el Estado reconoce el derecho universal y progresivo de toda persona a la seguridad social, para su protección frente a las contingencias que precise la ley y para la elevación de su calidad de vida, así como el libre acceso a prestaciones de salud y a pensiones, a través de entidades públicas, privadas o mixtas, y supervisa su eficaz funcionamiento.
