Sin embargo, el día 30 de agosto se produce una reunión entre congresistas y el candidato de APP para la gobernación de La Libertad (Trujillo), en donde con toda claridad que la agenda del Congreso no es determinada desde dentro, de la junta directiva, de la junta de portavoces, sino desde afuera, es el candidato mencionado el que fija la agenda, en plena etapa electoral para gobierno municipales y regionales, puntualizó.
Configurándose en todo lo anterior en una falta grave al ordenamiento jurídico nacional. Hemos esperado todo el día para ver si la junta directiva del Congreso de la República da un paso al costado al haber potenciado la inseguridad jurídica y que perjudica económicamente al país, como ejecutivo estamos promoviendo las inversiones nacionales e internacionales, empresas grandes, pequeñas; están ampliando sus inversiones y estableciendo otras nuevas, y los empresarios ante esta inestabilidad política que crea inseguridad jurídica, optan por retirarse.
El premier peruano sostuvo que aquí estamos apreciando una actividad que linda con el delito, hemos esperado a la Fiscalía de la Nación, reaccione, como reacciona para otros hechos, pero aquí sobre la bases de pruebas contundentes ya que esos audios existen, y no han sido negados, es más, los autores han manifestado que sí se han reunido, incluso han aceptado los hechos, entonces porque la fiscalía no ha intervenido, porque no ha hecho las incautaciones debidas de los instrumentos del delito, que hecho la Defensoría del Pueblo y quienes las dirigen, que muchas veces salen a secundar las noticias que dan los medios de comunicación sin dar las pruebas, y aquí no dicen nada, que hace la Procuraduría, y la prensa por supuesto se ha pronunciado de una forma anecdótica, refirió el premier peruano.
NORMAS QUE SE HAN VIOLADO.
Se han trasgredido la Ley 27815 Ley del código de ética del funcionario público, en artículo 8 “Prohibición ética de la función pública “en su inciso 3, usando el lugar físico del Congreso para llevar a cabo sus delitos. También infringen el Código de Ética Parlamentaria, en su artículo 4 item “d”, artículo 8, violando flagrantemente este código del parlamento nacional. El Congreso ha debido de actuar inmediatamente por el daño que se causa a la nación y no lo ha hecho.
Del mismo modo se viola en estos actos, la Ley 26859 Ley Orgánica de Elecciones, artículo347, y lo más grave el literal “d” de la misma norma, el Jurado Nacional Especial de Elecciones de Trujillo, también ya ha debido de actuar de oficio. Del mismo se ha violado gravemente la Resolución N° 0922-2021-JNE “Reglamento sobre propaganda electoral, publicidad estatal y neutralidad en el periodo electoral” en su artículo32, inciso 32.1, y la 32.1.2.
También se pisotea la Ley 31288 en artículo 4 sobre uso de los bienes o recursos públicos, aquí se tipifica como la presidenta del Congreso utiliza al parlamento como un instrumento para llevar a cabo consolidar las ventajas y beneficios a su candidato en plena etapa electoral del país, es decir el local del Congreso es utilizado para esta finalidad reñida totalmente al estado de derecho.
Finalmente Aníbal Torres Vásquez, indicó que en el Código Penal, en el artículo 388 Peculado de Uso, dispone que el funcionario o servidor público que para fines ajenos al servicio usa o permite que otros use vehículos, maquinas o cualquier otro instrumento de trabajo pertenecientes a la administración pública o que se hayan bajo su guarda, será reprimido con pena privativa de la libertad no menor de dos ni mayor de cuatro años, e inhabilitación según corresponda conforme a los incisos 1, 2 y 8, del artículo 36, y con 180 a 375 días multas, todo ello relacionado al peculado de uso, detalló el titular de la PCM.
AUDIO DE CÉSAR ACUÑA, LADY CAMONES, CONGRESISTAS Y OTRAS PERSONAS.
Presidenta de la mesa directiva del Congreso de la República, Lady Camones: “se ha llenado el Congreso de gente que…hay demasiada gente…demasiada gente…entonces se entiende que sí, pues hay que dar la mano a las personas que nos han ayudado , pero en los puestos que deben estar”; luego interviene el presidente del partido político Alianza Para el Progreso y aspirante a gobernador de la región La Libertad César Acuña Peralta, que dice: “Y eso fue parte del acuerdo para la presidencia, yo me acuerdo que el acuerdo para armar el bloque, para que Lady sea presidenta se hablaba de que se va a hacer una agenda en común , y que haya un compromiso de todas las semanas se apruebe un proyecto de ley, un proyecto de ley de cada bancada, para que estén contentos”.
Luego, seguidamente se escucha en dicho al mismo César Acuña Peralta, expresar: “Aparte de eso, hoy tengo un proyecto que tienen que sacar en estos días, el Alto Trujillo, que es estratégico, saben que eso tiene 120 mil electores ¿no?, ese proyecto de Alto Trujillo me va a favorecer a mí, ahorita estamos acordando ante la agenda, la estrategia para ayudarme a mí, es que esta semana Lady pueda hablar al presidente (en alusión al que preside la Comisión de Descentralización del parlamento) sáquenme el dictamen de este proyecto, lo que hay que evitar es que se cuelguen del proyecto…acá no es el alcalde, acá es APP, porque la bancada no la tiene el alcalde, la tiene APP, la tengo yo”.
Luego en tono a Virrey de plazuela, César Acuña Peralta, ordena con estas expresiones francamente oprobiosas: “Esta semana tarea para ustedes, no sé cómo lo hacen, dictamen de la comisión de descentralización, La siguiente semana entra a agenda, lo aprueba el Congreso, y ahí vas tu allá, de va Lady allá, hacemos un gran…”.
CONSPIRANDO A DESASTABILIZAR EL ORDEN CONSTITUCIONAL

Luego interviene en dichas conversaciones, Luis Valdez (secretario general APP) “Podemos sacar mil comunicados, presidente, y no nos van a creer, yo creo y coincido con la congresista Mary Acuña que debemos presentar nosotros una moción de vacancia firmada por los congresistas de APP, solamente así vamos a poder despojarnos de esa carga política y social que hoy nos atribuyen, no hay otra forma. Los comunicados se los pueden llevar el viento”.
Seguidamente de le escucha decir a César Acuña Peralta, “Para Salvar al Partido”, si yo no procedo, no ganan, entonces chau APP. Mira, se pierde la región La Libertad, chau…chau…chau…APP.
Interrumpe entonces un interlocutor no identificado, pero que por las expresiones que vierte, se trataría de un congresista de Alianza Para el Progreso, y dice: “Para mí sería mejor, en vez que sea como que, ahora, como estamos en la presidencia del Congreso, justo planteamos la vacancia, mejor APP se adhiere al pedido de Málaga, APP se adhiere a la moción de vacancia de Málaga, entonces, él nos aguanta un poco porque es caviar, los caviares aguantan a nombre de Dios, pero entonces, estamos respaldando sin ser nosotros los interesados, así firmemente, es él, pero nosotros ya definimos algo”.

Aparece en escena el congresista Alejandro Soto (APP) “Colegas, yo he participado en todos los acuerdos que se han tenido con el bloque democrático y creo, y a Richard le consta, que hemos quedado, presidente, que nadie va a lanzar una propuesta, como la que está haciendo la señora Keiko Fujimori.
