En salvaguarda del orden constitucional y el Estado de derecho, el  Pleno del Congreso de la República declaró la permanente incapacidad moral del presidente Pedro Castillo Terrones, su inmediata vacancia y, en consecuencia, la aplicación del régimen de sucesión establecido en el artículo 115 de nuestra Carta Magna.

Esta medida se halla contenida en una Resolución Legislativa aprobada por amplia mayoría (101 votos a favor, 6 votos en contra y 10 abstenciones), y se encuentra sustentada  en el inciso 2 del artículo 113 de la Constitución Política del Perú, concordante con el artículo 117 de la misma.

Esta grave situación, se afirma en el dispositivo aprobado, ha sido generada por el ciudadano Pedro Castillo Terrones, “por pretender disolver el Congreso e impedir su funcionamiento de forma inconstitucional” y de esa manera intentar “usurpar funciones públicas, impedir el funcionamiento de los poderes del Estado, y violentar el orden establecido por la Constitución política”.

Además, se señaló que el artículo 46 de la Constitución Política establece que “Nadie debe obediencia a un gobierno usurpador, ni a quienes asumen funciones públicas en violación de la Constitución y de las leyes”, y por tanto “son nulos los actos de quienes usurpan funciones públicas”.

Es por todo ello que, “ante la flagrancia de los actos delictivos cometidos por el ciudadano Castillo Terrones, corresponde que se adopten las medidas contempladas por la Constitución en defensa de la democracia y el Estado de derecho”.

In safeguarding the constitutional order and the rule of law, the Plenary of the Congress of the Republic declared the permanent moral incapacity of President Pedro Castillo Terrones, his immediate vacancy and, consequently, the application of the succession regime established in article 115 of our Magna Carta.

This measure is contained in a Legislative Resolution approved by a large majority (101 votes in favor, 6 votes against and 10 abstentions), and is supported by paragraph 2 of article 113 of the Political Constitution of Peru, consistent with article 117 of the same.

This serious situation, it is stated in the approved device, has been generated by the citizen Pedro Castillo Terrones, “for trying to dissolve Congress and impede its operation in an unconstitutional manner” and in this way try to “usurp public functions, prevent the operation of the powers of the State, and violate the order established by the Political Constitution”.

In addition, it was pointed out that article 46 of the Political Constitution establishes that “No one owes obedience to a usurping government, nor to those who assume public functions in violation of the Constitution and the laws”, and therefore “the acts of those who usurp public functions”.

It is for all these reasons that, “in the face of the flagrant acts of criminal acts committed by the citizen Castillo Terrones, it is appropriate that the measures contemplated by the Constitution in defense of democracy and the rule of law be adopted.”
