Agencia Peruana de Noticias PRENSAPERU.PE https://prensaperu.pe Twitter: @prensaperupe Con el compromiso de un trabajo honorable y eficiente, el flamante presidente del Poder Judicial, Javier Arévalo Vela, afirmó que ejecutará su plan de gobierno 2023-2024 sintetizado en “una justicia de calidad con rostro humano en la era digital”.

Su discurso lo brindó esta mañana en la ceremonia de asunción de cargo como máxima autoridad del Poder Judicial y de Apertura del Año Judicial 2023, que tuvo como invitadas a las autoridades de las principales instituciones del Estado.

EJES ESTRATÉGICOS
El juez supremo explicó que su mandato se basará en ocho ejes estratégicos para fortalecer el servicio judicial: autonomía e independencia de la función jurisdiccional, transparencia y lucha contra la corrupción; descarga procesal, modernización institucional.

También, en el fortalecimiento de la capacidad institucional, magistrados y recursos humanos, acceso a la justicia y compromiso con la seguridad ciudadana.

Sostuvo que durante su gestión “seremos celosos defensores de la independencia judicial frente a otros poderes y órganos del Estado; así como frente a los poderes fácticos que cada día tratan de influir en las decisiones de los jueces con el pretexto de representar el sentir de la opinión pública”.

“A todos aquellos que traten de inmiscuirse en el funcionamiento del Poder Judicial, les opondremos aquella histórica frase tan usada por el bando republicano durante la guerra civil española: ‘NO PASARÁN’”, advirtió.

Consideró que es importante para la independencia judicial acabar con la provisionalidad, por lo que instó a la Junta Nacional de Justicia que, dentro de sus atribuciones, proceda a llevar adelante los concursos que permitan contar con jueces titulares.

CONTRA LA CORRUPCIÓN
La autoridad judicial indicó que emprenderá una lucha frontal contra la corrupción judicial y administrativa en todas las áreas de la institución, por lo que promoverá mecanismos para transparentar las decisiones judiciales.

De ese modo, perfeccionará la plataforma de publicación de las sentencias de los órganos jurisdiccionales, lo que permitirá conocer cómo resuelven los jueces, favoreciendo así la predictibilidad de las decisiones.

Refirió que para acelerar la descarga procesal establecerá una nueva forma de medición de la productividad jurisdiccional, mejorando sus indicadores a través de la ponderación de las variables que midan el avance del expediente de acuerdo con su importancia en cada etapa procesal.

Los mencionados indicadores, señaló, serán puestos a disposición de cada órgano jurisdiccional, estableciéndose metas, y se difundirán los rankings para fomentar la sana competencia y el cumplimiento de metas entre los juzgados a nivel nacional, siendo reconocidos los servidores que superen dichas metas.

“Esta estrategia debe ir acompañada de una buena gestión de las bases de datos, del uso intensivo de la tecnología, de la interconexión de los sistemas existentes en el Poder Judicial y de la mejora de los procesos administrativos y su estandarización simplificada”, subrayó.

JUSTICIA CON ROSTRO HUMANO
Remarcó que una justicia con rostro humano no es ajena a la transformación digital, continuará con la implementación del Expediente Judicial Electrónico en todas las especialidades y cortes del país, contando con el apoyo del juez supremo Héctor Lama More.

“Buscaremos que la modernización llegue a todas las especialidades, priorizando aquellas vinculadas a los sectores más vulnerables de la población, como son los temas laborales, del adulto mayor y de las personas con discapacidad”, añadió.

Sobre el fortalecimiento de la capacidad institucional, indicó que mediante el Centro de Investigaciones Judiciales perfeccionará la sistematización de las resoluciones de la Corte Suprema y de las cortes con el fin de difundir las líneas jurisprudenciales que son dictadas en esas instancias.

Adelantó que mejorará la calidad de los datos estadísticos para lograr la toma de decisiones con transparencia, lo que contribuirá al plan de descarga y la organización del despacho.

PROYECTO DE LEY
Señaló que propondrá al Congreso un proyecto de ley para regular las remuneraciones y beneficios de los magistrados y la escala remunerativa de los servidores jurisdiccionales y administrativos del Poder Judicial.

Al reconocer como un principio de la función jurisdiccional el derecho a la tutela jurisdiccional, anunció que solicitará al Consejo Ejecutivo del Poder Judicial crear o convertir órganos jurisdiccionales de ejecución en materia laboral, pensionaria, familia y alimentaria, además de instar a las cortes superiores a brindar prioridad a la etapa de ejecución de los procesos, sobre todo los de naturaleza social.

Para enfrentar la inseguridad, Arévalo Vela refirió que promoverá una alianza estratégica contra la delincuencia con el Ministerio Público, la Policía Nacional y demás organismos competentes.

“Un tema que nos afecta es la violencia contra la mujer, la cual rechazamos y condenamos, al igual que rechazamos todo acto de violencia y odio contra otras colectividades en situación de vulnerabilidad”, subrayó en otro momento de su mensaje.

INVOCACIÓN A LA PAZ Y LA UNIDAD
Sobre la situación actual que devino en una espiral de violencia, con el saqueo e incendio a los locales del Poder Judicial, Ministerio Público y Policía, Arévalo Vela enfatizó que respalda toda acción dirigida a defender el Estado de Derecho, la democracia y la fortaleza de las instituciones.

Añadió que en el Poder Judicial “somos fieles defensores del Estado Constitucional de Derecho y del respeto absoluto a la Constitución Política del Perú, por eso creemos que nuestra Carta Magna solo puede reformarse por los mecanismos que ella ha previsto”.

Invocó “a la paz y a la unidad entre peruanos, porque solo así podremos superar los graves problemas que el país afronta, siendo este el único escenario donde los derechos se respetan por igual”.

“Nosotros desde nuestra posición nos comprometemos a ofrecer a la Nación un servicio de justicia de calidad con rostro humano, que esté al servicio de todos los peruanos, especialmente de los más vulnerables”, puntualizó.

“To all those who try to interfere in the functioning of the Judiciary, we will oppose that historic phrase so used by the Republican side during the Spanish civil war: ‘THEY WILL NOT PASS’,” he warned.

He considered that it is important for judicial independence to end the provisional status, for which he urged the National Board of Justice to proceed, within its powers, to carry out the contests that allow for permanent judges.

AGAINST CORRUPTION
The judicial authority indicated that it will undertake a frontal fight against judicial and administrative corruption in all areas of the institution, for which reason it will promote mechanisms to make judicial decisions transparent.

In this way, it will perfect the platform for publishing the judgments of the courts, which will allow knowing how the judges decide, thus favoring the predictability of the decisions.

He said that to speed up the procedural discharge, he will establish a new way of measuring jurisdictional productivity, improving its indicators through the weighting of the variables that measure the progress of the file according to their importance in each procedural stage.

The aforementioned indicators, he pointed out, will be made available to each jurisdictional body, establishing goals, and the rankings will be disseminated to promote healthy competition and the fulfillment of goals among the courts at the national level, being recognized the servers that exceed said goals.

“This strategy must be accompanied by good database management, the intensive use of technology, the interconnection of existing systems in the Judiciary and the improvement of administrative processes and their simplified standardization,” he stressed.

JUSTICE WITH A HUMAN FACE
He stressed that justice with a human face is no stranger to digital transformation, he will continue with the implementation of the Electronic Judicial File in all specialties and courts in the country, with the support of Supreme Judge Héctor Lama More.

“We will seek modernization to reach all specialties, prioritizing those linked to the most vulnerable sectors of the population, such as labor issues, the elderly and people with disabilities,” he added.

Regarding the strengthening of institutional capacity, he indicated that through the Center for Judicial Investigations he will perfect the systematization of the resolutions of the Supreme Court and the courts in order to disseminate the jurisprudential lines that are dictated in those instances.

He announced that the quality of the statistical data will improve to achieve transparent decision-making, which will contribute to the unloading plan and the organization of the office.

BILL
He indicated that he will propose to Congress a bill to regulate the remuneration and benefits of magistrates and the remuneration scale of judicial and administrative servers of the Judiciary.

Recognizing the right to judicial protection as a principle of the jurisdictional function, he announced that he will request the Executive Council of the Judiciary to create or convert jurisdictional bodies for enforcement in labor, pension, family and food matters, in addition to urging superior courts to Give priority to the process execution stage, especially those of a social nature.

To face insecurity, Arévalo Vela said that he will promote a strategic alliance against crime with the Public Ministry, the National Police and other competent agencies.

“An issue that affects us is violence against women, which we reject and condemn, just as we reject all acts of violence and hatred against other communities in vulnerable situations,” he stressed at another point in his message.

INVOCATION TO PEACE AND UNITY
Regarding the current situation that became a spiral of violence, with the looting and burning of the premises of the Judiciary, the Public Ministry and the Police, Arévalo Vela emphasized that he supports any action aimed at defending the Rule of Law, democracy and the strength of the institutions.

He added that in the Judiciary “we are faithful defenders of the Constitutional State of Law and of absolute respect for the Political Constitution of Peru, for this reason we believe that our Magna Carta can only be reformed by the mechanisms that it has foreseen.”

He invoked “peace and unity among Peruvians, because only in this way can we overcome the serious problems that the country faces, this being the only scenario where rights are respected equally.”

“From our position, we are committed to offering the Nation a quality justice service with a human face, which is at the service of all Peruvians, especially the most vulnerable,” he pointed out.
