Queridos compatriotas:
En los últimos días, como todos lo hemos apreciado, el país se ha visto envuelto en una espiral de violencia que ha perjudicado a todo el Perú, pero, sobre todo, a los más desfavorecidos.

Pudimos apreciar con indignación que nuestra Policía Nacional ha sido agredida a mansalva por un grupo organizado de individuos que quieren sembrar el caos y el odio entre los peruanos.

A esa misma hora, el Congreso de la República debatía el adelanto de elecciones al 2023.

Y como ya sabemos a esta hora: un debate estéril que no se ha llegado a nada concreto, excepto la reconsideración que mañana va a debatirse y que, esperamos, merezca una segunda reflexión, dada la gravedad de la situación. Reitero que este vacío es inaceptable para el Perú.

Las autoridades que representamos al Estado, tenemos el deber de proteger a todas y todos los peruanos, salvaguardando la seguridad del país y garantizando la tranquilidad y la paz social de nuestro querido Perú. Y de esta responsabilidad no se exceptúa el Congreso de la República.

Hermanas y hermanos, depende única y exclusivamente del Congreso de la República la responsabilidad de aprobar el adelanto de elecciones para este año 2023.

Por ello, anuncio que, de no prosperar el consenso en el Congreso el día de mañana para debatir el adelanto de elecciones al 2023, estaremos presentando inmediatamente dos iniciativas legislativas con carácter de urgencia.

La primera, es debatir una reforma constitucional para que las elecciones generales sean indefectiblemente este año 2023. La primera vuelta en octubre y la segunda, de ser el caso, en diciembre.

Estas cuestiones implican, como es evidente, una reforma constitucional que incorpore disposiciones transitorias especiales a efectos de regular la situación de excepción descrita.

La propuesta aborda fundamentalmente los siguientes supuestos:
a) Se establece el recorte del periodo presidencial, de los congresistas de la república y de los representantes ante el Parlamento Andino elegidos en las Elecciones Generales del 2021.

b) Se dispone, además, que el presidente de la república convoque a elecciones generales para el segundo domingo de octubre de este año 2023.

c) El Congreso de la República puede aprobar otras leyes necesarias para la realización de las elecciones generales del 2023, hasta el 28 de febrero de este año, no siendo de aplicación el plazo dispuesto en el artículo 4 de la Ley Orgánica de Elecciones.

Estimados compatriotas:
Esta propuesta normativa responde a la imperiosa necesidad de mejorar los niveles de legitimidad democrática de la representación política del país, situación que va a permitir a la población canalizar institucionalmente, y no por la violencia,sus principales demandas a la agenda política nacional.

La segunda propuesta es un proyecto ley que está destinado a zanjar de una vez por todas el debate sobre la reforma de la Constitución, tema que es permanentemente utilizado por algunas fuerzas políticas para menoscabar cualquier salida democrática a la actual situación.

Concretamente me refiero a proponer que el próximo Congreso elegido le encargue a la Comisión de Constitución la reforma total de la Constitución de 1993.

Este proyecto de ley calza perfectamente en la expectativa que tiene el otro sector del Congreso que también quiere hacer reformas políticas mediante una Asamblea Constituyente. Como ya lo dije, ya no habría más pretextos para que este adelanto de elecciones se de este 2023.

¿Qué proponemos?
En primer lugar, que el proceso de reforma total de la Constitución del 93 tiene su base legal en la Ley que está vigente, la 27600, publicada el 16 de diciembre del 2001.

Y ¿qué dice esta ley?
Que el Congreso proponga un proyecto de reforma total de la Constitución, tomando en cuenta la Constitución histórica del Perú.

Tras su aprobación por el Congreso, será sometida a referéndum para que el pueblo decida si la reforma total se aprueba o no.

La propuesta del Ejecutivo, con esta iniciativa legislativa, busca una amplia participación de la ciudadanía, en especial de aquellos sectores más excluidos de la sociedad.

De este modo, todas las personas e instituciones podrán presentar sus anteproyectos o sus aportes al Congreso de la República. Además, la Comisión de Constitución deberá promover la participación activa de la población en el debate para el diseño y aprobación de la reforma constitucional.

Señoras y señores congresistas, tienen que entender su responsabilidad histórica. El día de mañana tienen la oportunidad de ganarse la confianza del país, atendiendo esta demanda tan esperada por el pueblo peruano. Voten por el Perú, a favor del país, adelantando las elecciones al 2023 y digámosle al Perú entero con la más alta responsabilidad que nos vamos todos.

We were able to appreciate with indignation that our National Police has been attacked at large by an organized group of individuals who want to sow chaos and hatred among Peruvians.

At that same time, the Congress of the Republic was debating the advancement of elections to 2023.

And as we already know at this time: a sterile debate that has not reached anything concrete, except for the reconsideration that will be debated tomorrow and that, we hope, deserves a second reflection, given the seriousness of the situation. I reiterate that this vacuum is unacceptable for Peru.

The authorities that represent the State have the duty to protect each and every Peruvian, safeguarding the security of the country and guaranteeing the tranquility and social peace of our beloved Peru. And the Congress of the Republic is not excepted from this responsibility.

Sisters and brothers, the responsibility of approving the advancement of elections for this year 2023 depends solely and exclusively on the Congress of the Republic.

Therefore, I announce that, if consensus does not prosper in Congress tomorrow to discuss the advancement of elections to 2023, we will immediately be presenting two legislative initiatives as a matter of urgency.

The first is to debate a constitutional reform so that the general elections are unfailingly this year 2023. The first round in October and the second, if applicable, in December.

These issues imply, as is evident, a constitutional reform that incorporates special transitory provisions in order to regulate the exceptional situation described.

The proposal basically addresses the following assumptions:
a) It establishes the shortening of the presidential term, of the congressmen of the republic and of the representatives before the Andean Parliament elected in the General Elections of 2021.

b) It is also provided that the President of the Republic call general elections for the second Sunday of October of this year 2023.

c) The Congress of the Republic may approve other laws necessary for the holding of the 2023 general elections, until February 28 of this year, the term provided in article 4 of the Organic Law of Elections not being applicable.

Dear compatriots:
This regulatory proposal responds to the urgent need to improve the levels of democratic legitimacy of the country’s political representation, a situation that will allow the population to institutionally channel, and not through violence, its main demands to the national political agenda.

The second proposal is a bill that is intended to settle once and for all the debate on the reform of the Constitution, an issue that is permanently used by some political forces to undermine any democratic solution to the current situation.

Specifically, I am referring to proposing that the next elected Congress entrust the Constitution Commission with the total reform of the 1993 Constitution.

This bill fits perfectly into the expectation of the other sector of Congress that also wants to make political reforms through a Constituent Assembly. As I already said, there would be no more pretexts for this early election to take place in 2023.

What do we propose?
In the first place, that the process of total reform of the Constitution of 1993 has its legal basis in the Law that is in force, Law 27600, published on December 16, 2001.

And what does this law say?
That Congress propose a project for the total reform of the Constitution, taking into account the historical Constitution of Peru.

After its approval by Congress, it will be submitted to a referendum so that the people decide if the total reform is approved or not.

The Executive’s proposal, with this legislative initiative, seeks broad citizen participation, especially those sectors most excluded from society.

In this way, all persons and institutions will be able to present their preliminary projects or their contributions to the Congress of the Republic. In addition, the Constitution Commission should promote the active participation of the population in the debate for the design and approval of the constitutional reform.

Ladies and gentlemen of Congress, you have to understand your historical responsibility. Tomorrow they have the opportunity to earn the trust of the country, meeting this long-awaited demand by the Peruvian people. Vote for Peru, in favor of the country, advancing the elections to 2023 and let us tell all of Peru with the highest responsibility that we are all leaving.
