UN FRENO A LA PERSECUCIÓN JUDICIAL
Desde el Ejecutivo respetamos la independencia de poderes y la libertad de prensa, pero lamentablemente ya no sorprende que el Ministerio Público cometa excesos contra la presidenta de la república o miembros del gabinete ministerial, y que domingo a domingo un sector de la prensa arremeta también contra la jefa del Estado o algún ministro.

Constitucionalmente, la presidenta Dina Boluarte personifica a la nación. Sin embargo, algunos que no quieren darse cuenta de ello y la vapulean, incluso en su condición de mujer, tanto que el Ministerio de la Mujer y Poblaciones Vulnerables ha expresado su protesta ante la falta de respeto mediante un comunicado.

Estas agresiones son intolerables y apuntan, desde una facción de la prensa y un grupo específico de la fiscalía, dar un golpe blanco. Quieren minar la institucionalidad desprestigiando a la presidenta. Buscan hilar una vacancia.

Son excesos de la fiscalía y un mal uso de la libertad de expresión e información, a la cual, reitero, el Gobierno guarda un respeto irrestricto. Rechazo estas acciones políticas desestabilizadoras que reafirman una persecución judicial que merece un freno. Este acoso fiscal sistemático a la mandataria es inconstitucional e ilegal.

Cada semana aparecen en televisión partes de investigaciones a la presidenta y a otros miembros del Ejecutivo ¿Acaso el Ministerio Público no resguarda esas investigaciones?.

Este atropello a la presidenta data de hace casi un año, cuando se allanó cinematográficamente su casa, lo que afectó la dignidad de la Presidencia de la República y de la persona que, insisto, representa a todos los peruanos.

Al resolver la demanda competencial presentada por el Ejecutivo, el Tribunal Constitucional definirá cuáles las únicas causales para investigar a la presidenta.

El Ministerio Público debería tener precaución cuando formula denuncias contra la jefa de Estado porque ella está protegida por el artículo 117 de la Constitución, que dice cuáles son los 4 delitos por los que puede ser acusada: traición a la Patria; impedir elecciones presidenciales, parlamentarias, regionales o municipales; disolver el Congreso, salvo en los casos previstos en el artículo 134; o impedir su reunión o funcionamiento, o los del Jurado Nacional de Elecciones y otros organismos del sistema electoral. El correlato lógico es que solo por esos cuatro delitos pueda ser investigada. Y esas razones no se han cumplido en la realidad.

Confío en la sapiencia del TC para sentar jurisprudencia y fortalecer la gobernabilidad, indispensable para afianzar el crecimiento económico. Pese a todo, hago votos para que prime el debido proceso y renuevo mi confianza en la imparcialidad de operadores de justicia alejados de sesgos políticos. El Perú no merece que estos sean marionetas de intereses oscuros.

A BRAKE ON JUDICIAL PERSECUTION
We in the Executive Branch respect the independence of branches of government and freedom of the press, but unfortunately, it is no longer surprising that the Public Prosecutor’s Office commits excesses against the President of the Republic or members of the cabinet, and that every Sunday a sector of the press also attacks the Head of State or a minister.

Constitutionally, President Dina Boluarte personifies the nation. However, some people ignore this and attack her, even in her capacity as a woman. The Ministry of Women and Vulnerable Populations has expressed its protest against the lack of respect in a statement.

These attacks are intolerable and, from a faction of the press and a specific group within the prosecutor’s office, aim to stage a coup. They want to undermine the institutional framework by discrediting the president. They are seeking to concoct a vacancy.

These are excessive actions by the prosecutor’s office and a misuse of freedom of expression and information, which, I reiterate, the government respects unreservedly. I reject these destabilizing political actions that reaffirm a judicial persecution that deserves to be halted. This systematic prosecutorial harassment of the president is unconstitutional and illegal.

Every week, sections of investigations into the president and other members of the executive branch appear on television. Doesn’t the Public Prosecutor’s Office safeguard these investigations?

This violation of the president dates back almost a year, when her home was raided on film, undermining the dignity of the Presidency of the Republic and of the person who, I insist, represents all Peruvians.

In resolving the jurisdictional claim filed by the executive branch, the Constitutional Court will determine the only grounds for investigating the president.

The Public Prosecutor’s Office should exercise caution when filing charges against the head of state because she is protected by Article 117 of the Constitution, which stipulates the four crimes for which she can be charged: treason; preventing presidential, parliamentary, regional, or municipal elections; dissolving Congress, except in the cases provided for in Article 134; or preventing its meeting or operation, or those of the National Elections Jury and other electoral system bodies. The logical consequence is that she can be investigated only for these four crimes. And these reasons have not been fulfilled in reality.

I trust in the wisdom of the Constitutional Court to establish jurisprudence and strengthen governability, which is essential to securing economic growth. Despite everything, I hope that due process prevails and renew my confidence in the impartiality of justice officials free from political bias. Peru does not deserve these individuals to be puppets of dark interests.
