Trujillo on Alert! The Executive branch seeks legislative action on security as crime defies the nation. More powers or better results? The State is reinforcing its presence, but the violence demands deep-seated reforms, not merely a police deployment.
Peruvian News Agency PRENSAPERU.PE https://www.prensaperu.pe Twitter: @prensaperupe The growing wave of criminal violence in the city of Trujillo has compelled the Government of President Keiko Fujimori to activate a reinforced deployment of the National Police and coordinate joint actions with the Armed Forces, in explicit recognition that the scale of the phenomenon exceeds the State’s conventional response capacity. Prime Minister Luis Galarreta announced these measures from the Government Palace and, simultaneously, reaffirmed the urgency for the Congress of the Republic to delegate legislative powers in matters of citizen security, arguing that the current legal framework limits intelligence capabilities, law enforcement intervention, and prison control. This report analyzes these measures from a holistic and critical perspective, examining both the immediate operational response and the structural and public policy reforms the issue demands, beyond the current situation.
THE CONTEXT: THE SECURITY CRISIS IN TRUJILLO AND THE EXECUTIVE’S RESPONSE
The city of Trujillo, capital of the La Libertad region, has recently become the scene of episodes of criminal violence that have shaken public opinion and forced the Government of President Keiko Fujimori to activate an immediate action plan. From the Government Palace, Prime Minister Luis Galarreta Velarde, accompanied by Minister of Defense Rafael Belaunde and Minister of the Interior César Astudillo, announced the strengthening of National Police operations in the area and coordination with the Armed Forces to contain and dismantle the criminal organizations responsible.
“This situation is unacceptable, and we reject this violence. The National Police are conducting various operations. The Minister of Defense will travel to the La Libertad region and, there, will report on the actions to be carried out together with the Armed Forces,” stated the head of the Ministerial Cabinet, making it clear that the State will not remain passive before the deterioration of public order. The measure implies coordinated deployment between law enforcement agencies and the defense sector, in explicit acknowledgment that the scale of the criminal phenomenon at times exceeds the response capacity of a single security force.
The Prime Minister emphasized that the Executive will maintain permanent surveillance of the evolution of events and will proceed to identify and prosecute those intellectually and materially responsible: “We will await the reports later tonight and tomorrow morning. We will also see who has been identified as the ringleaders of this regrettable situation we have experienced in La Libertad.” The reference to ringleaders reveals that the phenomenon is not limited to isolated common crime, but to organized structures with hierarchy, planning, and mobilization capacity.
STRUCTURAL DIMENSION: BETWEEN THE IMMEDIATE RESPONSE AND THE DELEGATION OF LEGISLATIVE POWERS
The Government has stated that operational reinforcement — police and military — is necessary but insufficient unless accompanied by profound regulatory changes. In this regard, the Executive has again highlighted the urgency for the Congress of the Republic to approve the request for delegation of legislative powers in matters of citizen security, presented by the Executive Branch. The central argument is that the current legal framework limits the State’s capacity for action against increasingly complex, violent, and organized forms of criminality.
Galarreta explained that one of the priority objectives of these powers is to strengthen the State’s intelligence capabilities, so that it is possible to detect in advance the formation and movements of criminal gangs, rather than reacting once violence has already broken out: “It is extremely important that our intelligence service be able to carry out operations it does not have today, to detect these criminal gangs in a timely manner. Ultimately, there is violence in the city, and that is what we want to stop.” This statement reveals a critical gap between information-gathering capacity and the ability to transform it into preventive action.
Likewise, it seeks to expand the scope of action of the Armed Forces in matters of citizen security, clearly defining the scenarios in which they may intervene and the coordination mechanisms with the National Police: “It is also important to identify and determine hostile groups toward these criminal gangs, so that our Armed Forces can take action in this regard.” The proposal also contemplates strengthening security at penitentiary establishments — external perimeters and access control — and granting the National Police access to classified information from intelligence services, elements that have been identified as weaknesses in the current system.
The Government’s message is explicit and far-reaching: “This is a message to these criminals: we, as a State, will not stop confronting them. Along the way, we have been studying several actions that we will surely implement soon.” However, from a critical perspective, it must be noted that the effectiveness of these measures will depend not only on their approval, but also on their implementation, budget allocation, legal oversight, and outcome evaluation. Citizen security is not achieved solely through increased armed presence or more laws, but through a comprehensive approach that combines prevention, prosecution, rehabilitation, and improvement of the social conditions that fuel violence.
PUBLIC POLICIES: BEYOND THE EMERGENCY
The situation in La Libertad demonstrates the need for long-term, sustainable State policies free from short-term political considerations. From a holistic perspective, intervention is required in at least six fundamental areas:
1.- Reform and Strengthening of the State Intelligence System: Fragmentation of intelligence services, lack of information-exchange protocols between institutions, and insufficient human and technological resources limit the State’s anticipatory capacity. It is necessary to integrate information systems, standardize analysis criteria, and train specialists in criminal intelligence, under a strict framework of democratic oversight and respect for fundamental rights.
2.- Clear Legal Framework for Coordination Between Law Enforcement and Armed Forces: The intervention of the Armed Forces in internal security tasks must be legally defined with precision, delimiting competencies, operational scenarios, chain of command, and responsibilities. Inter-institutional cooperation cannot depend on circumstantial decisions, but rather on an institutional design that guarantees effectiveness and respect for the rule of law.
3.- State Penitentiary Policy: Penitentiary establishments have ceased to be custody centers and have become spaces from which crimes are directed. Perimeter security, communications control, inmate classification, and the effective implementation of social reintegration programs are urgent. Crime cannot be combated if crimes continue to be ordered from within prisons.
4.- Social Prevention of Violence: Criminal violence has structural roots: exclusion, youth unemployment, educational deficits, and urban inequality. Repressive measures without prevention policies are doomed to failure. The State must invest in social inclusion programs, family strengthening, safe public spaces, and opportunities for youth.
5.- Reform of the Criminal Justice System: Procedural delays, impunity, and the judicial system’s limited capacity to process and sentence promptly are factors that incentivize criminality. Citizen security is not achieved with more police alone, but with sufficient judges, prosecutors, and public defenders equipped to act swiftly and firmly.
6.- Evaluation, Transparency, and Accountability: Any security measure must be periodically evaluated. The Government must present public reports on the impact of operations, the use of legislative powers, and results obtained, enabling citizens and Congress to exercise oversight over Executive Branch actions.
CONCEPTUAL DEFINITIONS
Citizen Security: A social condition in which people may exercise their rights and freedoms with full respect for the law and without threats to their integrity, property, or environment. It is not reduced to the absence of crime, but to confidence in the State’s capacity to guarantee it through legitimate and effective institutions.
Criminal Organization: A hierarchical and permanent structure of three or more persons acting in coordinated fashion to commit serious crimes, obtaining economic or other benefits. It differs from common crime through its planning, scope, and capacity for social and territorial influence.
Delegated Legislative Powers: A constitutional authority (Article 104) by which Congress authorizes the Executive Branch to issue norms with the force of law on specified matters and for a fixed term. It requires an enabling law that sets the subject matters, limits, and term of exercise, and may be repealed or modified by the Legislature.
Intelligence for Citizen Security: The systematic activity of collecting, analyzing, and disseminating information aimed at identifying, preventing, and neutralizing threats against internal order and public tranquility. Its value lies in timeliness and accuracy, not in the violation of fundamental rights.
Inter-agency Security Coordination: Cooperation mechanisms, joint command, and articulation between the National Police and the Armed Forces, as well as among the Interior, Defense, and Justice sectors. Its absence generates duplication of efforts, competence gaps, and risk of disproportionate intervention.
Crime Prevention: A set of social, urban, educational, and policing policies oriented toward reducing risk factors that foster violence and criminality. It differs from repression through its anticipatory character and its focus on causes rather than solely on the consequences of the criminal phenomenon.
CONCLUSIONS
1.- Operational reinforcement in Trujillo is a necessary response to the emergency, but by itself it does not resolve the underlying problem. The violence manifesting in the streets is the visible expression of a criminal organization that has grown under legal loopholes, institutional weakness, and lack of timely intelligence. Containing immediate events is the first step, but eradicating the phenomenon requires addressing its structural causes.
2.- The request for legislative powers poses a central dilemma: the need for more effective legal tools versus the imperative of guaranteeing democratic oversight and respect for fundamental rights. Any expansion of State capacities must be accompanied by clear accountability mechanisms, explicit limits, and parliamentary and judicial oversight, to ensure that the fight against criminality does not ultimately affect the freedoms it seeks to protect.
3.- The intervention of the Armed Forces in citizen security tasks requires a clear and defined legal framework that precisely establishes when, how, and under what responsibilities they may act in the internal sphere. Citizen security is, by definition, the primary responsibility of the National Police; the Armed Forces fulfill a complementary and exceptional role that must not replace or weaken police functions, nor become permanent practice without public debate.
4.- The penitentiary crisis is a determining factor in citizen insecurity that can no longer be postponed. If crimes continue to be ordered and coordinated from detention centers, no external security measure will suffice. Strengthening penitentiary perimeters, controlling communications, and classifying inmates are urgent measures that must be accompanied by comprehensive reform of the prison system, including genuine social reintegration programs.
5.- Citizen security cannot be reduced to a matter of public order: it is also a problem of social, economic, and cultural development. Criminal gangs find fertile ground in exclusion, lack of opportunity, and the abandonment of urban and rural spaces. Without public policies that address the living conditions of the population, especially young people, any repressive measure will be insufficient and temporary in effect.
6.- Security is a matter of State policy, not government or circumstantial policy. It requires lasting consensus, sustained budget allocation, and continuity in strategies beyond administrative changes. Congress and the Executive must engage in dialogue not to approve urgent measures under pressure, but to build a citizen security framework that responds to the country’s reality with a long-term vision.
