Realmente, el día de hoy hemos conversado bastante tiempo de la solicitud del indulto presidencial a favor del ciudadano José Pedro Castillo Terrones. Así es, en las normas correspondientes en el Fundamento de la Constitución de la Facultad Presidencial, el artículo 118 del inciso 21 de la Constitución Política del Perú, establece que corresponde al presidente de la República conceder indulto y conmutar penas.

Esta atribución constituye una potestad constitucional exclusiva de jefe de Estado, de naturaleza discrecional pero no arbitraria, enmarcada dentro del principio de la juridicidad que rige toda actuación de poder público en el artículo 45 de la Constitución Política del Perú. El Tribunal Constitucional ha señalado que el indulto es una institución de derecho público que opera como una causa de extensión de ejecución de pena en virtud de una decisión soberanía del presidente de la República en el expediente 003660-2010 de Tribunal de Constitución y otros pronunciamientos relacionados con la naturaleza jurídica del indulto. Entonces, en este caso, el indulto está dado. Entonces, en el último párrafo que hemos presentado, que el cumplimiento del procedimiento administrativo correspondiente ante el Ministerio de Justicia y Derechos Humanos y la Comisión de Gracia Presidencial se conceda el indulto presidencial a favor del ciudadano José Pedro Castillo Terrones mediante la resolución suprema debidamente motivada.

Es una medida de gracia el indulto presidencial. ¿Por qué? Porque la Constitución del Perú es la Carta Magna. Hasta ahorita no tenemos otra Constitución del Estado. Entonces, cualquier reglamento, cualquier resolución o decreto del Congreso que puedan actuar, eso no enmarca a la Constitución del Perú. La Carta Magna está dada a nivel nacional y a nivel mundial del Estado peruano. Entonces, esta Constitución nadie la puede borrar, hermanos de todo el Perú. Efectivamente, acá nos está citando a partir del día 20, seguramente vamos a sustentar en el Palacio de Gobierno nosotros, conjuntamente con el doctor José María Balcázar Celada, cual presidente de la República.

Vamos a sustentar el indulto presidencial como medida de gracia para nuestro presidente, para que salga inmediatamente de este penal de Barbadillo hacia nuestra sociedad de todo el Perú. Efectivamente, nosotros tenemos, creo que la mayoría de la población del Perú, en mayoría se ha pedido el indulto presidencial. Desde mucho antes, seguramente esto ha venido, pero no había ningún tipo de documentos, pero ahorita ya tenemos el documento de fecha, 26 de febrero del 2026.

Efectivamente, nosotros nada tenemos que ver en el proceso electoral, nosotros lo único que queremos es al presidente verlo al lado de la sociedad del Perú. Para mí es un honor salir a la población, salir y desde acá, comunicarle a todo el estado peruano que el indulto de nuestro presidente no es, como les digo, en ningún momento dicen que tiene que tener sentencia ejecutada, ni mucho menos en ningún momento, porque los reglamentos puede haber, pero no la Constitución Política del Perú, no lo pueden violar la ley. Desde acá mando mis saludos a nuestros compatriotas, a nuestros seguidores, el abogado del pueblo siempre está al servicio de la sociedad a nivel de todo el Perú.

People’s Lawyer Raúl Choquenaira Announces Request for Presidential Pardon for Former President Pedro Castillo; Bases Measure on the Constitution.

In statements to PrensaPerú, he indicated that “today we came to visit Barbadillo, where our president, José Pedro Castillo Terrones, is. We actually discussed at length today the request for a presidential pardon for Mr. José Pedro Castillo Terrones. Indeed, the relevant provisions in the Constitutional Basis of the Presidential Power, specifically Article 118, Section 21 of the Political Constitution of Peru, establish that it is the President of the Republic’s responsibility to grant pardons and commute sentences.”

This power constitutes an exclusive constitutional authority of the Head of State, of a discretionary nature but not arbitrary, framed within the principle of legality that governs all actions of public power in Article 45 of the Political Constitution of Peru. The Constitutional Court has stated that pardon is a public law institution that operates as a cause for the suspension of the execution of a sentence by virtue of a sovereign decision of the President of the Republic in file 003660-2010 of the Constitutional Court and other rulings related to the legal nature of the pardon. Therefore, in this case, the pardon has been granted. Therefore, in the last paragraph we have submitted, it is stated that upon completion of the corresponding administrative procedure before the Ministry of Justice and Human Rights and the Presidential Clemency Commission, the presidential pardon be granted in favor of citizen José Pedro Castillo Terrones through a duly motivated supreme resolution.

Presidential pardon is an act of grace. Why? Because the Constitution of Peru is the Magna Carta. To date, we have no other Constitution of the State. Therefore, any regulation, any resolution or decree of Congress that may be enacted does not supersede the Constitution of Peru. The Magna Carta applies at the national level and to the Peruvian State on the international stage. Therefore, no one can erase this Constitution, brothers and sisters of all Peru. Indeed, we have been summoned as of the 20th; we will surely argue our case at the Government Palace, together with Dr. José María Balcázar Celada, the President of the Republic.

We will argue for the presidential pardon as an act of grace for our president, so that he may immediately leave this Barbadillo prison and rejoin the society of all Peru. Indeed, we believe that the majority of Peru’s population has requested the presidential pardon. This has surely been an ongoing matter for a long time, but there were no relevant documents until now; however, we now have the dated document, February 26, 2026.

Indeed, we have nothing to do with the electoral process; the only thing we want is to see the president alongside the society of Peru. It is an honor for me to address the public, to come forward and from here inform the entire Peruvian State that the pardon of our president does not, as I say, in any way require that a sentence have been enforced, nor is this required at all, because while there may be regulations to that effect, the Political Constitution of Peru cannot be violated by any law. From here I send my greetings to our compatriots, to our supporters; the people’s lawyer is always at the service of society throughout Peru.
