El pleno del parlamento peruano por insistencia aprobó la ley que desarrolla el ejercicio de la cuestión de confianza.

“78 votos más 1, 79 votos a favor”, dijo la presidenta del Congreso María del Carmen Alva Prieto, quien bajó al llano para manifestar su voto a favor de la insistencia. Fue en la sesión que dirigió el martes 18 en el hemiciclo principal de sesiones.

Se trata de los proyectos de ley 3, 6, 19 y 36, cuyo dictamen propuesto por la Comisión de Constitución y Reglamento fue aprobado por la Representación Nacional el pasado 16 de setiembre.

De esta manera, la iniciativa establece, en su único artículo, “que la facultad que tiene un ministro y la del presidente del Consejo de Ministros a nombre del consejo, de plantear una cuestión de confianza conforme al último párrafo del artículo 132 y al artículo 133 de la Constitución Política del Perú, está referida a materias de competencia del Poder Ejecutivo relacionadas directamente a la concreción de su política general de Gobierno; no encontrándose, entre ellos, las relativas a la aprobación o no de reformas constitucionales ni las que afecten los procedimientos y las competencias exclusivas y excluyentes del Congreso de la República o de otros organismos constitucionalmente autónomos”.

Además, en su disposición complementaria final, señala que “la cuestión de confianza es aprobada o rehusada luego de concluido el debate y luego de realizada la votación conforme al Reglamento del Congreso. El resultado de la votación es comunicado expresamente al Poder Ejecutivo, mediante oficio, para que surta efecto. Solo el Congreso de la República puede interpretar el sentido de la votación”.

Inmediatamente después de la votación fue presentada una reconsideración a la votación por el congresista Nivardo Edgard Tello Montes, de Perú Libre, al observar que no fue votada la cuestión previa que presentó durante el debate. El pedido no prosperó toda vez que alcanzó 40 votos a favor, 80 en contra y 1 abstención.

LAS OBSERVACIONES
Patricia Juárez informó que el Poder Ejecutivo presentó siete observaciones respecto de la autógrafa que fuera aprobada por el Pleno del Congreso el pasado 16 de setiembre.

Una de las observaciones señala que la cuestión de confianza es un contrapeso de la censura ministerial y añade que ninguna norma infraconstitucional puede vaciar de contenido dicha institución o desnaturalizar el balance de poderes.

“La cuestión de confianza como mecanismo de contrapeso a la censura que hace referencia el presidente de la República está regulada en el primer párrafo del artículo 132 de la Constitución Política. Esta no ha sido considerada en la ley aprobada por el Congreso. La observación parte de un error de lectura”, aclaró Juárez.

El Ejecutivo también observa que el Congreso no puede hacer una reforma constitucional de forma discrecional y agrega que existen límites formales y materiales para realizar reformas constitucionales.

Con relación a los limites formales y materiales para realizar una reforma a la Constitución Política, la congresista Juárez afirmó que el Congreso coincide con el Poder Ejecutivo en que se deben respetar tales parámetros; sin embargo, dijo que, esta comisión no logra entender el motivo de la observación, puesto que el Congreso durante este periodo legislativo 2021-2022 no ha aprobado ninguna ley de reforma constitucional y la ley que se ha observado es una de desarrollo constitucional, que es de naturaleza distinta a una reforma constitucional.

Otra observación advierte que la autógrafa de ley es una reforma constitucional implícita puesto que altera el sentido del texto constitucional y, sin embargo, se ha tramitado como una ley ordinaria.

Al respecto Juárez afirmó lo siguiente: “coincidimos con el Poder Ejecutivo cuando afirma que vía una ley ordinaria no se pueden realizar reformas constitucionales”; sin embargo, señaló que, debemos aclarar nuevamente que este Congreso, a la fecha, no ha aprobado ninguna reforma constitucional en general, y que la ley materia de observación es una de desarrollo constitucional.

“Lo que estamos haciendo es restablecer el equilibrio perdido por el abuso de este mecanismo bajo la idea de que la Constitución Política no lo prohíbe de forma expresa; y claro, bajo el razonamiento de que lo que no está prohibido, está permitido se desnaturalizó su uso con un fin perverso de debilitar a un Congreso que no le era a fin a sus intereses políticos”, sostuvo Juárez en relación con la cuestión de confianza planteada por el expresidente del Consejo de Ministros, Salvador del Solar, sobre una reforma constitucional.

DICTAMEN EN MINORÍA
Los congresistas Edgard Reymundo Mercado (JPP) y Jaime Quito Sarmiento (PL) presentaron un dictamen en minoría sobre la base de las observaciones planteadas por el Poder Ejecutivo.

Respecto del dictamen de insistencia Reymundo, señaló que con una ley interpretativa o de desarrollo constitucional se pretende materializar una reforma constitucional, cuando se sabe que el mecanismo para modificar la Constitución es a través de una ley de reforma constitucional.

“Se busca allanar la cancha para que proceda la vacancia presidencial sabiendo que existe el equilibrio de poderes como esencia de la democracia. No respetan el artículo 206 de la Constitución que dice que se requiere la aprobación en dos legislaturas continuas y con 87 votos a favor”, agregó.

CUESTIÓN PREVIA
Antes del debate, la congresista Katy Ugarte Mamani (PL) afirmó que el Poder Ejecutivo ha presentado un el Proyecto de Ley nro. 474/ 2021 de reforma constitucional que fortalece la gobernabilidad entre los poderes Ejecutivo y Legislativo y propone modificaciones sobre la misma materia.

“Propongo cuestión previa para que este asunto cuente con mayor análisis, hacer llegar a los miembros Consejo Consultivo y que retorne a la Comisión de Constitución por no encontrar el suficiente estudio y debate sobre la cuestión de confianza”, añadió.

El pedido de la legisladora no prosperó, toda vez que, al ser puesta al voto alcanzó 39 votos a favor y 79 en contra.

EL DEBATE
El congresista Luis Ángel Aragón Carreño (AP) inició el debate recordando que la cuestión de confianza es una institución jurídica autónoma e independiente, regulada en la Constitución que tiene por propósito que el Ejecutivo busque el respaldo respecto de las políticas públicas del Gobierno; sin embargo, subrayó que hay que ser claros, porque existen competencias exclusivas y excluyentes que son del Congreso de la República.

“No sé porque se trata de vincular la cuestión de confianza con la vacancia presidencial, creo que no hay que confundir. El espíritu de mi bancada no es golpista”, sostuvo.

Por su parte, Alejandro Muñante Barrios (RP) observó que en estos momentos no existe un balance de poderes en nuestro país y el Poder Ejecutivo puede presentar cuestión de confianza por cualquier cosa. “El Ejecutivo puede presentar cuestión de confianza sobre las políticas públicas, pero no por materias que no le compete”, dijo el legislador al tiempo de asegurar que lo que se busca es delimitar las funciones que cada poder del Estado debe tener con el dictamen de insistencia.

A su turno, la legisladora María Acuña Peralta (APP) pidió reflexionar sobre el propósito que tiene el dictamen de insistencia que busca el equilibrio de poderes, y que el Poder Ejecutivo respete las facultades que tiene el Congreso. “No significa que estemos buscando la vacancia del presidente”, anotó.

Por considerar que el dictamen de insistencia contiene graves errores de fondo y de forma, el legislador José María Balcázar Zelada (PL) pidió que retorne a la comisión dictaminadora para que sea debatido ampliamente.

Por su lado, Alex Randu Flores Ramírez (PL) observó que lo que se pretende es aprobar por insistencia una ley inconstitucional. “Aquí lo que están queriendo es continuar con el golpe de Estado en ciernes. Si quieren hacer una reforma constitucional que se vote como corresponde”; en tanto que, Silvana Robles Araujo (PL) sostuvo que lo que se quiere es limitar facultades al presidente de la República en funciones.

A su vez, Cruz María Zeta Chunga (FP) opinó que la cuestión de confianza debe ser debidamente interpretada. “Está referida a materias exclusivas del Poder Ejecutivo relacionadas a las políticas generales de Gobierno y no sobre la aprobación de reformas constitucionales. No estamos buscando la vacancia, estamos buscando la democracia, porque así lo pide nuestro país”, señaló.

Mientras que el parlamentario Wilson Soto Palacios (AP) afirmó que hace poco el Congreso de la República cumplió 199 años como institución e invocó a sus colegas a defender el fuero parlamentario. En ese mismo sentido se pronunció el legislador Alejandro Cavero (Avanza País): “Los congresistas sin color político debemos defender nuestro fuero y es nuestra responsabilidad restablecer el equilibrio de poderes”, señaló.

“Ustedes podrán tener los votos, pero no tiene la razón; lo que tienen es una mayoría abusiva”, dijo en su intervención el congresista Guillermo Bermejo (PL).

Por su parte, Ruth Luque Ibarra (JPP) sostuvo que hoy se está consumando un fraude constitucional, porque se tienen los votos. “Esta insistencia se va aprobar con el voto de quienes creen que defienden el principio de equilibrio de poderes, pero eso es mentira; lo que se está haciendo es instalar una forma de dictadura parlamentaria para aplastar y socavar el poder del Ejecutivo de quienes no han aceptado perder en las elecciones”, concluyó la legisladora. En tanto que, su colega Sigrid Bazán invocó a los parlamentarios a retomar el rol legislativo del Congreso y aprobar leyes importantes para la reactivación económica del país.
