Agencia Peruana de Noticias PRENSAPERU.PE https://prensaperu.pe/ Twitter: @prensaperupe La Comisión de Defensa del Consumidor y Organismos Reguladores de los Servicios Públicos, presidida por Elías Varas Meléndez (PB), aprobó por unanimidad, con 16 votos a favor, el dictamen que recomienda insistir en la autógrafa de la ley que modifica la Ley 29571, Código de Protección y Defensa del Consumidor, a fin de ampliar la prohibición de las comunicaciones spam.

La autógrafa había sido observada el pasado 2 de mayo por la Presidencia de la República por supuesta afectación al principio de coherencia normativa y falta de justificación de la necesidad de la misma, entre otros argumentos.

Durante la sustentación del dictamen de insistencia, el legislador Elías Varas Meléndez (PB) afirmó que la propuesta aprobada por el Pleno del Congreso, el 29 de marzo del presente año, no vulnera la libertad de empresa, dado que no prohíbe la implementación de centrales de llamadas, solo norma su desempeño.

Así mismo, sostuvo que el derecho a la salud se antepone ante cualquier otro derecho fundamental, por lo cual se desestiman las observaciones realizadas por el Poder Ejecutivo, en el marco del derecho a la defensa de la persona humana y su dignidad.

Esta iniciativa contiene los proyectos de ley nros. 2942; 3131 y 3541, y con la aprobación del dictamen en insistencia, será debatida por la representación nacional en las siguientes sesiones plenarias.

La propuesta modifica los literales d) y e) del artículo 58 de la Ley 29571, y tiene como fin prohibir que las empresas realicen llamadas o envíen mensajes de texto para promover sus productos y servicios, sin que estos hayan sido solicitados por el consumidor.

Además, la comisión aprobó, por unanimidad, el dictamen que propone la insistencia de la iniciativa legislativa 3049, que plantea incorporar progresivamente en la plataforma Mejor Atención al Ciudadano a los organismos reguladores de los servicios públicos y a su vez declarar de interés nacional la creación e implementación progresiva de la Ventanilla del Consumidor y Usuario.

También se aprobó, con 13 votos a favor, el Proyecto de Ley 3049, propuesto por José Luna Galvez (PP), que busca establecer que los cementerios y servicios funerarios no cobren tarifas diferenciadas por urgencia o necesidad, por lo cual deberán publicar los precios de sus servicios en el ingreso de los establecimientos.

Por su parte, la congresista Digna Calle Lobatón (PP) sustentó el Proyecto de Ley 4360, que propone reconocer el derecho a los consumidores a solicitar gratuitamente el bloqueo de la aplicación de banca móvil.

Asimismo, el legislador Esdras Medina (SP) expuso los alcances del PL nro. 4372, por medio de la cual se busca simplificar el sistema de protección de productos industriales, al otorgarle facultades al Estado para fiscalizar y sancionar conductas que vulneren dicha normativa.

En otro momento de la sesión, debido a las denuncias recibidas por los consumidores, se presentó el presidente ejecutivo del Organismo Nacional de Sanidad Pesquera – SANIPES, Víctor Aro Corrales, quien expuso sobre las labores que realiza la institución que lidera para garantizar la inocuidad de los recursos hidrobiológicos.

Los integrantes de la comisión también acordaron solicitar al Consejo Directivo que se les derive el Proyecto de Ley 1564, para elaborar el dictamen correspondiente. A su vez, el presidente de la comisión anunció que se desarrollará este 22 de mayo una sesión descentralizada en la región Moquegua.

The proposal modifies subparagraphs d) and e) of article 58 of Law 29571, and its purpose is to prohibit companies from making calls or sending text messages to promote their products and services, without these having been requested by the consumer.

In addition, the commission unanimously approved the opinion that proposes the insistence of legislative initiative 3049, which proposes progressively incorporating public service regulatory bodies into the Better Citizen Service platform and, in turn, declaring the creation and progressive implementation of the Consumer and User Window.

Also approved, with 13 votes in favor, was Bill 3049, proposed by José Luna Galvez (PP), which seeks to establish that cemeteries and funeral services do not charge differentiated rates due to urgency or necessity, for which they must publish the prices of their services at the entrance of the establishments.

For her part, Congresswoman Digna Calle Lobatón (PP) supported Bill 4360, which proposes recognizing the right of consumers to request the blocking of the mobile banking application free of charge.

Likewise, the legislator Esdras Medina (SP) exposed the scope of PL no. 4372, through which it seeks to simplify the system for the protection of industrial products, by granting powers to the State to monitor and punish behaviors that violate said regulations.

At another point in the session, due to the complaints received by consumers, the executive president of the National Fisheries Health Agency – SANIPES, Víctor Aro Corrales, presented himself, who spoke about the work carried out by the institution he leads to guarantee the safety of hydrobiological resources.

The members of the commission also agreed to request the Board of Directors to refer Bill 1564 to them, to prepare the corresponding opinion. In turn, the president of the commission announced that a decentralized session will be held this May 22 in the Moquegua region.
