Obtuvo 103 votos a favor, 2 votos en contra y 4 abstenciones., y fue exonerada de segunda votación.

Se trata de la iniciativa legislativa nro. 397/2021, cuya autoría recae en el congresista Ernesto Bustamante Donayre (FP). En su artículo único, modifica la disposición final primera de la Ley 29158, Ley Orgánica del Poder Ejecutivo.

El titular de la Comisión de Descentralización, Regionalización, Gobiernos Locales y Modernización de la Gestión del Estado, Alejandro Cavero Alva (Avanza País), afirmó que la finalidad de esta norma es actualizar “Regularizar” la Ley Orgánica del Poder Ejecutivo (LOPE), los nombres de los ministerios que fueron creados o modificados en su denominación, de forma posterior a la dación de la misma, en el año 2007.

Básicamente, continuó, “lo que se propone es uno, incluir los ministerios de Ambiente, Cultura e Inclusión Social, que fueron creados luego de la dación de la Ley Orgánica del Poder Ejecutivo; y dos, adecuar la nueva denominación de algunos de los sectores de acuerdo con las leyes que así lo disponen”, en referencia al Ministerio de Desarrollo Agrario y Riego.

Además, señaló, se incluyó en el texto sustitutorio a la Presidencia del Consejo de Ministros, por ser también un ministerio.

Cavero Alva resaltó que esta propuesta de actualización “no implica la creación de nuevos ministerios ni introduce nuevas denominaciones, sino únicamente actualiza la Ley Orgánica del Poder Ejecutivo a lo que dispone la normativa vigente”.

En ese sentido, “se trata de un acto legislativo de coherencia normativa que no afecta la competencia exclusiva y excluyente del Poder Ejecutivo en materia de la organización ministerial de conformidad con el artículo 22 de su ley orgánica”.

In that sense, “it is a legislative act of normative coherence that does not affect the exclusive and exclusive competence of the Executive Branch in matters of ministerial organization in accordance with article 22 of its organic law.”
