Obtuvo 49 votos en contra 46 en contra 11. De acuerdo con el artículo 78 del reglamento congresal, el dictamen aprobado será sometido a segunda votación transcurrido siete días calendario.
La iniciativa aprobada que precisa el ámbito del horario de trabajo y modifica la ley de jornada de trabajo, horario y trabajo en sobretiempo; se sustenta en los Proyectos de Ley 1192 y 2306, ambos del 2021; y para cumplir su cometido modifica los artículos 1 y 8 del mencionado decreto legislativo.
El titular de la Comisión de Trabajo y Seguridad Social, Pasión Dávila Atanacio (BMCN), precisó que de acuerdo con el texto sustitutorio, puesto a disposición de la Representación Nacional, se entiende como “horario de trabajo, no necesariamente el trabajo efectivo que pueda desempeñar el trabajador a favor del empleador, sino la puesta a disposición de su tiempo y bajo subordinación al empleador”.
En cuanto a la modificación del artículo 8, indicó que cuando “se realice la jornada en horario nocturno debe garantizarse un periodo de descanso de por lo menos onces horas antes de que inicie el siguiente turno. (…)”.
