La iniciativa legislativa, aprobada con 114 votos a favor, 1 voto en contra y cero abstenciones, se sustenta en los Proyectos de Ley 374/2021, 1423/2021 y 4356/2022.

El titular de la Comisión de Educación, Juventud y Deporte, José Balcázar Zelada (PB), sostuvo que las observaciones del Ejecutivo carecen de relevancia, y por ello insisten en la fórmula aprobada, ya que “se trata de docentes que van a pasar a la ley universitaria de acuerdo a su jerarquía”.

Sin embargo, se aceptaron algunas de las cinco observaciones del Poder Ejecutivo y, al mismo, se mantiene “el texto originario de las otras disposiciones o artículos observados, de conformidad con el artículo 79-A del Reglamento del Congreso de la República”.

El dispositivo legal contienes cuatro artículos. El primer artículo incorpora la Disposición Complementaria Final Decimotercera en la Ley 30220, Ley Universitaria, en donde se establece que los docentes civiles de las instituciones de educación superior del Ministerio de Defensa y del Ministerio del Interior se rigen por las normas de la carrera docente universitaria.

En el segundo artículo se modifica el artículo 10 del Decreto Legislativo 1318, Decreto Legislativo que regula la formación profesional de la Policía Nacional del Perú, para determinar que a los docentes civiles se le debe aplicar la Ley 30220, Ley Universitaria.

En el tercer artículo se establecen los requisitos y los plazos para el cambio de régimen laboral de los docentes civiles y el proceso de incorporación.

En el literal tercero de este artículo se mantiene el requisito de que los “docentes civiles nombrados bajo el régimen del Decreto Legislativo 276 que no cumplan con los requisitos regulados en la Ley 30220, Ley Universitaria, para incorporarse en la carrera docente universitaria tienen un plazo no mayor de tres años para hacerlo”.

El cuarto artículo precisa que lo dispuesto “se financia con cargo a los presupuestos institucionales del Ministerio de Defensa y del Ministerio del Interior sin demandar recursos adicionales al tesoro público”.

The legislative initiative, approved with 114 votes in favor, 1 vote against and zero abstentions, is based on Bills 374/2021, 1423/2021 and 4356/2022.

The head of the Education, Youth and Sports Commission, José Balcázar Zelada (PB), maintained that the Executive’s observations are irrelevant, and that is why they insist on the approved formula, since “these are teachers who are going to move on to university law according to its hierarchy.”

However, some of the five observations of the Executive Branch were accepted and, at the same time, “the original text of the other provisions or articles observed is maintained, in accordance with article 79-A of the Regulations of the Congress of the Republic.”

The legal device contains four articles. The first article incorporates the Thirteenth Final Complementary Provision in Law 30220, University Law, which establishes that civilian teachers of higher education institutions of the Ministry of Defense and the Ministry of the Interior are governed by the rules of the university teaching career.

In the second article, article 10 of Legislative Decree 1318, Legislative Decree that regulates the professional training of the National Police of Peru, is modified to determine that Law 30220, University Law, must be applied to civilian teachers.

The third article establishes the requirements and deadlines for the change in the employment regime of civil teachers and the incorporation process.

In the third paragraph of this article, the requirement is maintained that “civilian teachers appointed under the regime of Legislative Decree 276 who do not comply with the requirements regulated in Law 30220, University Law, to join the university teaching career have a period no more than three years to do so.”

The fourth article specifies that the provisions “are financed from the institutional budgets of the Ministry of Defense and the Ministry of the Interior without requiring additional resources from the public treasury.”
