“Fue positiva. A diferencia de sus antecesores no solo expresó su preocupación por la promoción de puestos de trabajo sino detalló la labor que realiza en la promoción y creación de empleos. Por nuestra parte, comentamos sobre la importancia de las exportaciones, nuestro compromiso con el Perú e interés por ayudar a reducir la informalidad. Le solicitamos establecer metas e indicadores anualizados”, comentó.
Pérez Alván le entregó al titular del MTPE un documento con iniciativas en 2 aspectos: institucionales y laborales. En el primero de ellos sugirió retomar las sesiones del Grupo de Trabajo Multisectorial –creado mediante Resolución Ministerial N° 295-2023-TR–, a fin de proponer lineamientos para la gobernanza y el fortalecimiento Institucional de Essalud y establecer una estrategia integral que permita mejorar los servicios que brinda a los asegurados.
Asimismo, recuperar la confianza y reconstruir el diálogo social y concertación laboral en el Consejo Nacional de Trabajo y Promoción del Empleo (CNTPE) como espacio tripartito de concertación de políticas en materia de trabajo, promoción del empleo, capacitación laboral y protección social en beneficio de todos los peruanos.
También instó a establecer el principio de seguridad jurídica respecto al criterio de la Sunafil en el caso del derecho al descanso vacacional de los trabajadores a tiempo parcial.
En relación a la normatividad laboral, ADEX solicitó mantener la vigencia del régimen laboral establecido en el Decreto Ley N° 22342 (Ley de Promoción de Exportaciones No Tradicionales), pues la naturaleza temporal de los pedidos internacionales hace necesaria la contratación temporal, cumpliendo con una serie de requisitos establecidos. Requirió extenderlo a toda la cadena de exportación de productos no tradicionales y no solo a las empresas que exportan directamente.
De la misma manera, planteó derogar el D.S. 001-2022-TR (regula los servicios de tercerización) y el D.S. 014-2022-TR (reglamenta parte de la ley de relaciones colectivas de trabajo), emitidos sin debate en el CNTPE e incumpliendo el Convenio 144 de la OIT que establece que ‘las organizaciones de trabajadores y empleadores deben ser consultadas de manera efectiva en el proceso de adopción de instrumentos legislativos y reglamentarios susceptibles de afectar los intereses de sus miembros’.
En el documento ADEX pidió reglamentar la Ley N° 31602 publicada el 5 de noviembre del año pasado, la cual otorga a los trabajadores del sector privado licencia por fallecimiento de cónyuge, padre, hijo o hermanos.
También manifestó su preocupación respecto al proyecto de Ley N° 671 (propone incorporar los 45 minutos de refrigerio en las 8 horas de trabajo), lo que significaría un aumento de remuneración inmediato de casi el 10%, con lo cual el país continuará perdiendo competitividad frente a países que tienen regulaciones laborales más adaptadas a las exportaciones.
El gremio propuso eliminar los topes para el acogimiento a la Remuneración Integral Anual, lo cual ayudará a luchar contra la informalidad laboral que vulnera la normativa laboral, permite remuneraciones por debajo del mínimo legal e incumple con otorgar condiciones apropiadas de trabajo.
Sobre la necesidad de una reforma integral del sistema de pensiones y AFP en el país, opinó que debe incluir la participación del sector público, así como el análisis de la propuesta de creación del Seguro de Desempleo, que debe reemplazar a la CTS a partir del cuarto año de servicios, de lo contrario se generaría nueva carga al empleador.
Finalmente, pidió establecer una estrategia multisectorial, con la participación del sector privado, en la lucha frontal contra la informalidad y establecer como política de Estado su reducción en 3% al año, como mínimo.

In relation to labor regulations, ADEX requested to maintain the validity of the labor regime established in Decree Law No. 22342 (Non-Traditional Export Promotion Law), since the temporary nature of international orders makes temporary hiring necessary, complying with a series of established requirements. It required extending it to the entire export chain of non-traditional products and not only to companies that export directly.

Finally, he called for establishing a multisector strategy, with the participation of the private sector, in the frontal fight against informality and establishing its reduction by at least 3% per year as a State policy.
