“Desde el Ejecutivo rechazamos el uso indebido que hace la Fiscalía de la Nación de los mecanismos de justicia y de los medios procesales en contra de la jefa de Estado. No se puede instrumentalizar, a través de un organismo constitucional, una investigación que no es prolija para determinar, por lo menos, indicios de responsabilidad”, afirmó el jefe del Gabinete Ministerial.

El titular de la Presidencia del Consejo de Ministros subrayó que el abogado de la mandataria ha demostrado, desde una óptica jurídica, los errores en las denuncias presentadas y las afectaciones al debido proceso.

Adicionalmente, el titular de la Presidencia del Consejo de Ministros (PCM) precisó que, conforme al ordenamiento jurídico y al principio de separación de poderes, cada institución del Estado debe ejercer sus funciones dentro del ámbito de sus competencias, con respeto irrestricto a la Constitución.

En esa línea, el premier Arana también enfatizó que un jefe de Estado solo puede ser denunciado por las cuatro causales previstas en la carta magna, las cuales no se corresponden con las denuncias presentadas por el Ministerio Público.

“Ningún peruano, ni siquiera la presidenta de la república, está por encima o por debajo de la ley. Nadie puede estar sujeto al capricho o al criterio personal de una autoridad que, cuando lo estime conveniente, formule denuncias sin el debido sustento legal o vulnerando el debido proceso”, remarcó el premier.

INFORME SOBRE REMUNERACIÓN DE LA PRESIDENTA TIENE CARÁCTER RESERVADO
Respecto al carácter reservado de los documentos sobre la “Compensación Económica del puesto de funcionario en el Cuadro de Puestos de la Entidad del Despacho Presidencial”, el presidente del Consejo de Ministros, Eduardo Arana, explicó que dicha clasificación se ha establecido conforme a lo dispuesto por la Ley de Transparencia y Acceso a la Información Pública. “Lo que debemos hacer es cumplir con la ley”, afirmó.

No obstante, el titular de la PCM precisó que el informe en mención corresponde a un estudio elaborado por la Autoridad Nacional del Servicio Civil (SERVIR), el cual no ha sido implementado ni ha ingresado a la agenda del Consejo de Ministros. “La remuneración de muchos funcionarios supera a la de la presidenta. Por ello, consideramos que la reflexión planteada por esta entidad es adecuada y será analizada, debatida y eventualmente aprobada si se considera conveniente”, señaló.

MESA DE DESARROLLO SOSTENIBLE Y PACIFICACIÓN EN LA PROVINCIA DE PATAZ
El ministro de Energía y Minas, Jorge Montero, anunció que este jueves se llevará a cabo una reunión de trabajo en la ciudad de Trujillo (La Libertad) con el alcalde provincial de Pataz, autoridades locales, rondas campesinas y gremios de la pequeña minería que operan en la zona, con el propósito de definir el alcance de la Mesa de Desarrollo Sostenible y Pacificación en dicha provincia.

“The Executive Branch rejects the improper use by the Attorney General’s Office of the mechanisms of justice and procedural means against the head of state. An investigation that is insufficient to determine, at the very least, indications of responsibility cannot be instrumentalized through a constitutional body,” stated the head of the Cabinet.

The head of the Presidency of the Council of Ministers emphasized that the president’s lawyer has demonstrated, from a legal perspective, the errors in the complaints filed and the violations of due process.

Additionally, the head of the Presidency of the Council of Ministers (PCM) clarified that, in accordance with the legal system and the principle of separation of powers, each state institution must exercise its functions within the scope of its powers, with unrestricted respect for the Constitution.

Along these lines, Prime Minister Arana also emphasized that a head of state can only be impeached for the four reasons provided for in the Constitution, which do not correspond to the complaints filed by the Public Prosecutor’s Office.

“No Peruvian, not even the president of the republic, is above or below the law. No one can be subject to the whim or personal judgment of an authority that, when it deems it appropriate, files complaints without proper legal basis or in violation of due process,” the Prime Minister emphasized.

REPORT ON THE PRESIDENT’S REMUNERATION IS CONFIDENTIAL
Regarding the confidential nature of the documents on the “Financial Compensation for the Position of an Official in the Position Chart of the Presidential Office Entity,” the President of the Council of Ministers, Eduardo Arana, explained that this classification has been established in accordance with the provisions of the Transparency and Access to Public Information Law. “What we must do is comply with the law,” he stated.

However, the head of the PCM clarified that the report in question corresponds to a study prepared by the National Civil Service Authority (SERVIR), which has not been implemented nor included on the Council of Ministers’ agenda. “The remuneration of many officials exceeds that of the president. Therefore, we consider the reflection proposed by this entity to be adequate and will be analyzed, debated, and eventually approved if deemed appropriate,” he stated.

SUSTAINABLE DEVELOPMENT AND PEACEFULNESS TABLE IN THE PROVINCE OF PATAZ
The Minister of Energy and Mines, Jorge Montero, announced that a working meeting will be held this Thursday in the city of Trujillo (La Libertad) with the provincial mayor of Pataz, local authorities, peasant patrols, and small-scale mining associations operating in the area, with the purpose of defining the scope of the Sustainable Development and Pacification Table in that province.
